|f Childhood is a very sensitive stage in an individual's life, requiring special attention and care until the child has a good upbringing. Since, originally the child does not commit any crime, but (he commits so) as a result of the circumstances that may occur, or he falls in danger, and sometimes becomes a delinquent. \nTherefore, in order to protect him from the risk of delinquency, the Algerian legislature has given him legal protection and enacted a special law for him. This is the Law 15/12 of 15 July 2015 on the protection of the child, which provides him with protection to ensure that he is free from criminality and delinquency. One such protection for him is that is established in the follow-up and investigation stages, which is reflected in his protection during his arrest given his age, on the one hand. |a تعتبر مرحلة الطفولة مرحلة جد حساسة في حياة الفرد، تتطلب اهتمام ورعاية خاصة وذلك حتى ينشأ الطفل نشأة صالحة، ولما كان الأصل أن الطفل لا يرتكب أية جريمة، لكن ونتيجة لظروف ما قد يحدث وأن يصبح الطفل في خطر وقد يكون جانحا، لذلك وحماية له من خطر الانحراف خصه المشرع الجزائري بحماية قانونية وسن له قانونا خاصا به، ويتعلق الأمر بالقانون 15/12 المؤرخ في 15 يوليو 2015 المتعلق بحماية الطفل، حيث أفاده بحماية تكفل له الابتعاد عن الإجرام والانحراف، ومن هذه الحماية تلك المقررة له في مرحلتي المتابعة والتحقيق والتي تتجلى في حمايته أثناء التوقيف للنظر مراعاة لسنه من جهة، ومن جهة أخرى فإن تم توقيفه فقد أحاطه بمجموعة من الحقوق من أجل توجيهه وإعادة إدماجه داخل المجتمع.

|d L, enfance est une étape très sensible dans la vie de l, individu, nécessite une attention et un soin particuliers pour que l, enfant s,èpanouisse convenablement et valablement. \nA l, origine l, enfant n, est pas prédisposé un criminel, mais il arrive que des circonstances malheureuses le mettent en danger et le transforment en délinquant.\n Afin de protéger l, enfant contre le risque de délinquance le législateur a mise en place un arsenal juridique spécifié notamment la loi 15/12 du 15 juillet 2015 relative à la protection de l, enfant, qui constitue une garantie et une sécurité contre les risque de la criminalité et de la délinquance , cette protection couvre l,enfant durant les étapes de l, enquête et l, instruction et aussi durant sa garde à vue, en raison de son âge d, une part ,et d, autre part en cas de son arrestation de bénéficier d, un ensemble de droits qui lui permettront d, être orienté vers une réintégration facilitée au sein de la la société.\n
