تتبنى معظم الأنظمة السياسية المعاصرة، مبدأ عدم مسؤولية رئيس الدولة سياسيا أمام الهيئات التشريعية، وفقا لمبررات عديدة تختلف نتائجها، باختلاف طبيعة النظام السياسي المتبع، ولعل من بين هذه الأنظمة السياسية نجد النظام السياسي الجزائري الذي كرس في معظم دساتيره، باستثناء دستور 1963، تطبيقات هذا المبدأ. وكرس بدوره النظام السياسي التونسي لذات المبدأ في الدستور السابق لسنة 1959 وتعديلاته، وفي الدستور الحالي لسنة 2014. واستند كلا النظامين، على أسس هامة وسعت من عدم مسؤولية رئيس الجمهورية سياسيا أمام البرلمان، وهي الانتخاب المباشر من طرف الشعب للرئيس، ومركز هذا الأخير ودوره كضامن لوحدة الأمة والدولة ودوره كضامن لاستمرارية الدولة، غير أن ذلك يتوقف على دور الرئيس أيضا في مدى ممارسته لحجم السلطة التي يتمتع بها، وبالتالي مدى تحقيق التوازن بين ممارسة هذه السلطة ومسؤوليته السياسية عنها.
