هذا البحث والذي يحمل عنوان: (أثر المباشرة في العبادات والجنايات في الفقه الإسلامي)- اشتمل على مقدمة وثلاثة مباحث وخاتمة، المبحث الأول تم تخصيصه للمصطلحات والتعاريف، والمبحث الثاني دار الحديث فيه عن أثر المباشرة في العبادات- طهارة- حج- صوم- اعتكاف، وفي المبحث الثالث، سار الحديث فيه عن أثر المباشرة في الجنايات، وسار البحث على المنهج الوصفي والتحليل العلمي؛ وذلك من خلال تتبع مسائل المباشرة وأثرها في الفقه الإسلامي باختلاف مدارسه، وكان من أهدافه بيان أحكام أثر المباشرة في العبادات والجنايات، وبيان المقصد الشرعي من هذه المسائل وواجب المسلم في مراعاتها وذلك من خلال آراء الفقهاء وأدلتهم وكان من أهم النتائج التي توصل إليها البحث حرمة وطء الزوجة حال الحيض والنفاس، وفي الدبر وجواز الاستمتاع بالزوجة الحائض فيما دون الفرج، مباشرة الزوجة يفسد الحج والعمرة ويجب الهدي والقضاء، ويفسد الصوم، ويوجب الكفارة والقضاء، من شروط الضمان في الإتلاف تسببا، التعدي، والتعمد، وأن يؤدي السبب إلى النتيجة قطعا، دون تدخل سبب أخر بحسب العادة. ثم ختمت هذا البحث بأهم النتائج والتوصيات.
This research, which has the title: (The effect of performance on Worship and Felonies in Islamic Jurisprudence). This research included an introduction and three sections and a conclusion. The first section was devoted to terms and definitions. The second section discussed the effect of performance in worship - purity- Hajj - fasting- seclusion at mosque (i'tikaaf). In the third section, it discusses the effect of performance in felonies. The research proceeded on the descriptive approach and scientific analysis; this is through tracking issues of performance and their effect on Islamic jurisprudence in different schools. One of the main objectives of the research was to explain the provisions of the effect of performance in acts of worship and felonies, and to clarify the legitimate destination of these issues and the duty of a Muslim according to the opinions of jurists and their evidence. One of the most important results of the research was the prohibition of menstruating a wife during menstruation and postpartum, and in the anus and the permissibility of enjoying a menstruating wife without the vulva. Lovemaking the wife spoils the Hajj and Umrah and obliges the sacrificial and the predestine, and spoils the fast, and the penance and the predestine, from conditions for collateral damage- cause infringement and deliberate cause, and the cause will definitely lead to the result, without interfering with any other reason. Then I concluded this research with the most important results and recommendations.
