المستخلص: تتسم مادة القانون الجنائي للأعمال، بمجموعة من الخصوصيات التي تميزها عن القواعد الكلاسيكية المتعارف عليها في مادة القانون الجنائي، بحيث تشد قواعدها عن كثير من قواعد القانون الجنائي الكلاسيكي شكلا ومضمونا، أهمها خاصية المرونة في صياغتها، كما تتميز بالتشبع والتنوع في المجال بدءًا من مقتضيات مجموعة القانون الجنائي، ومدونة التعمير، مدونة الجمارك، مدونة التجارة وقوانين الشركات، مدونة الشغل، قانون حرية الأسعار والمنافسة، قانون الملكية الصناعية، مدونة التشريع الضريبي، قانون زجر الغش في البضائع، قانون حماية المستهلك، ومن هنا يأتي دور الاجتهاد القضائي الذي يلعب دورًا أساسيًا في تحديد مجال ومعالم هذه المادة، المعتبرة في حكم المواد التي هي قيد التشكل بالنسبة للحالة المغربية، ومن هنا تبرز أهمية الاجتهاد القضائي المغربي بصدد المساهمة في تحديد المعالم المميزة لها، والمرتبطة ببنية الاقتصاد الوطني.

Le droit pénal des affaires se caractérise par un ensemble de particularités qui le distinguent des règles classiques reconnues dans l'article de droit pénal, de sorte que ses règles resserrent bon nombre des règles du droit pénal classique dans la forme et le contenu, dont la plus importante est la propriété de la flexibilité dans sa formulation, ainsi que de la saturation et de la diversité dans le domaine à partir des exigences d'un groupe Droit pénal, Code de la construction, Code des douanes, Code de commerce et droit des sociétés, Code du travail, Droit de la liberté des prix et de la concurrence, Droit de la propriété industrielle, Code de la législation fiscale, Loi sur la fraude en matière de fraude dans les marchandises, Loi sur la protection des consommateurs,

The criminal law subject for business is characterized by a set of specificities that distinguish it from the classic rules recognized in the subject of criminal law, as its rules differ from many of the classic criminal law rules in form and content, the most important of which is the flexibility in formulating them. It is also characterized by saturation and diversity in the field starting from the provisions of the Criminal Law Group, the Construction Code, the Customs Code, the Commercial Code, and the Company Laws, the Labor Code, the Freedom of Prices and Competition Law, the Industrial Property Law, the Tax Legislation Code, the Commodity Fraud Law, Consumer Protection Law. Hence the role of jurisprudence, which plays a fundamental role in determining the scope and parameters of this article, considered in the judgment of articles that are under the process of formation in the Moroccan case. From here emerges the importance of Moroccan jurisprudence in the matter of contributing to defining the features that are distinctive to it and related to the structure of the national economy.
