المستخلص: Firstly: Clarification of Shariah vision on the misconceptions included in the International Covenant on Economic, Social and Cultural Rights, as follows: a) Acknowledgment that members of the human family have equal and absolute rights, with no distinction on base of the sex and the religion. b) Confirmation that a Muslim woman has right to marry a non-Muslim man. c) Inclusion of the woman by the International Covenant, in all the jobs and the services, and treating it as the women`s rights that must fulfilled and provided by the government. Secondly: Explaining the basis of the economic and social human rights ignored by the International Covenant: a) Islam shall impose on the wealthy Muslim families to ensure the basic necessities of the poor families, contrary to the International covenant. b) Islam is very keen to protect the needs of the families of the future generations from the wealth of their homeland, unlike the International Covenant. c) Islam requires the guardian`s consent for marriage lady under his guardianship. d) Requirement of the Islam for two witness on the marriage contract contrary the International covenant. e) Islam obligates on the husband to bear all the expenses related to the wife and the whole family as well, contrary to the International covenant. f) Islam assign the right of divorce to husband and not the woman, contrary to the International covenant. g) Islam doesn’t encourages the freely mixed gather of men and women in the educational and cultural gatherings. Thirdly: Explaining that Islam has already provided certain guaranties to ensure the necessary rights of the family and the woman. They are four: The first is the religious and divine observation; the second is the rule of law and the promotion of virtue and the prevention of vice; the third is the administrative control and the very serious inspection; and the fourth is fair judiciary and deterrent punishment. Fourthly: Declaring that amongst the general rights of all individual in the Islamic society is to participate and share and the responsibility ensuring and protecting rights of the family and the woman. Not to mention the responsibilities of the state and its institutions, as it is proven by the evidences and the practical facts from the Prophet`s (peace be upon him) guidance and his companions.
