La France est responsable des dommages causés à la population du Sahara et à la faune et à la flore. L’indemnisation des victimes des « essais nucléaires » français au Sahara est prévue par la loi Morin de 2010, modifiée en 2013. Celle-ci pose le principe de la reconnaissance des victimes des irradiations et leur indemnisation. Force est de constater qu’aucune victime algérienne n’a fait l’objet d’indemnisation alors que certaines victimes françaises ont été dédommagées. Les critères retenus: au fond (ratione loci, ratione personae, ratione temporis, ratione materiae), en la forme (procédure complexe et discriminatoire) sont pratiquement impossibles à réunir. De surcroît, la loi incriminée ne s’applique qu’à certaines catégories de personnes et n’inclut pas la totalité de la population du Sahara et encore moins l’environnement. Avec l’appui des experts nucléaires, des médias nationaux, des ONG et du soutien timoré du gouvernement algérien, les Associations des victimes des explosions atomiques françaises de Reggane et de In Ecker sont mobilisées pour faire aboutir leurs demandes d’indemnisation et faire amender la loi Morin. | ||
| 520 | |b Contribution to the study of indemnification for the victims of French atomic explosions in the Sahara France is responsible for damage caused to the population of the Sahara and the faune and flora. The indemnification of the victims of the French tests in the Sahara is treated by the Morin's law of 2010, modified in 2013. This latter takes into consideration the principle of the acknowledgement of the irradiation victims and their indemnification. However one has to notice that no one of the Algerian victims has been compensated while some of the French victims had been. The admitted criteria: basically (ratione loci, ratione personae, ratione temporis, ratione materae) and formally (complex and discriminatory procedure) are practically impossible to provide. Moreover this law applies only to some categories of people and not to the entirety of the Sahara population even less to environment. Thanks to the support of nuclear experts, national media, NGO’s and the timorous help of the Algerian government, the victims of the French atomic explosions of Reggane and In Icker are mobilised to make their demands come to a result and to amend Morin's law. | ||
