المستخلص: The legislator has defined the rights of the owner to use, use, exploit and dispose of the thing, provided that it is done within the limits of the law. Since ownership is a social function intended to achieve private and public interests, the general rule that the owner must observe in the exercise of his rights is not incompatible with the provisions of the laws, regulations and Shari'a decisions. As a result, the right to property can be subject to many legal restrictions. Some of these restrictions are determined for the public interest and others are determined for the private interest. These restrictions generally apply to the owner's powers of use and exploitation or the freedom to own property. It can be said that the legal restrictions on private real estate are many and difficult to limit them to their presence in several legal texts, some of which have been regulated by special laws such as the sale of property for public benefit, for example, including those organized by general legal rules, so that the researcher difficult to understand the absence of executive texts. Since legal restrictions represent the ordinary status of property rights, their survival remains subject to the continuation of the objective circumstances that were the reason for their imposition, regardless of whether or not they were actually used. Real estate ownership occupies an important place in society in terms of individual concerns. This has led the state to intervene in this property when certain conditions are available, restricting it to public benefit in the public interest. The public interest restrictions are of public order, which is derived primarily from the objective of public benefit, and in this capacity entails exposing the offenders to substantial penalties and fines. The restrictions of the private interest were imposed to address the problems posed by juxtaposition and to regulate the rights of contiguous neighbors, such as restricting the right of passage in the land of the neighbor confined to the land on the public road, and placing the boundary between two adjacent lands. Neighboring is a natural phenomenon associated with the existence of man, which necessitates the establishment of adjacent relations. And the restrictions of neighborhood, including the general restriction of non-abuse of the right, and the restriction of the disadvantages of the neighborhood is not familiar, and there are also the special neighborhood restrictions resulting from the convergence of property.

لقد بين المشرع حقوق المالك في الانتفاع بالشيء واستعماله واستغلاله والتصرف فيه بشرط أن يتم ذلك في حدود القانون. ولما كانت الملكية وظيفة اجتماعية يقصد بها تحقيق المصلحتين الخاصة والعامة، فإن القاعدة العامة التي يجب على المالك مراعاتها في استعمال حقوقه ألا يتنافى ذلك مع ما تقضي به القوانين واللوائح والقرارات الشرعية. ومؤدى ذلك أن حق الملكية يمكن أن ترد عليه الكثير من القيود القانونية، بعض هذه القيود يتقرر للمصلحة العامة والبعض الآخر يتقرر للمصلحة الخاصة، وترد هذه القيود بصفة عامة على سلطات المالك في الاستعمال والاستغلال أو على حرية التملك نفسها. ويمكن القول إن القيود القانونية الواردة على الملكية العقارية الخاصة هي كثيرة ويصعب حصرها لتواجدها في عدة نصوص قانونية، فمنها ما تم تنظيمها بقوانين خاصة كنزع الملكية للمنفعة العامة مثلا، ومنها من نظمت بقواعد قانونية عامة، بحيث يصعب على الباحث فهمها لغياب نصوص تنفيذية لها. ولما كانت القيود القانونية تمثل الوضع العادي لحق الملكية، فإن بقاءها يظل مرهونا باستمرار الظروف الموضوعية التي كانت سببا في فرضها بصرف النظر عن استعمالها فعليا من عدمه، وهذا يترتب عليه أنها لا تسقط بعدم الاستعمال. وتحتل الملكية العقارية مكانة هامة في المجتمع من حيث اهتمامات الأفراد، وهذا ما دفع بالدولة إلى التدخل في هذه الملكية متى توافرت ظروف معينة، حيث تقوم بتقييدها للمنفعة العامة تحقيقا للصالح العام. ويود المصلحة العامة هي من النظام العام، وهي صفة مستمدة أساسا من هدف تحقيق المنفعة العامة، ويترتب على هذه الصفة تعريض المخالفين لعقوبات جزائية وغرامات مالية لا يستهان بها. أما قيود المصلحة الخاصة فقد فرضت لعلاج المشاكل التي يثيرها التلاصق، وتنظيم حقوق المتجاورين المتنافرة، كقيد حق المرور في أرض الجار المحصورة أرضه عن الطريق العام، وقيد وضع الحدود بين أرضين متلاصقتين. ويعتبر الجوار ظاهرة طبيعية مرتبطة بوجود الإنسان، مما يفرض إنشـاء علاقات متجاورة. وقيود الجوار، منها العامة والمتمثلة في قيد عدم التعسف في استعمال الحق، وقيد مضار الجوار غير المألوفة، وهناك أيضا قيود الجوار الخاصة الناتجة عن تلاصق الأملاك.
