| 520 | |b Both law and language are indissociables, and they are studied a while ago, and are topicals subjects as well as in Algeria, than foreign countries as in international law, if the law exprimes by the language it trendier governing it. This is not without consequence for the professionals of the law and the translation. The legal linguistic is the study of language of the law. Jean Louis-Bergel’s legal methodologies work appeared in 2001, observed that "any term or expression has to indicate a concept and only one, like a label, to identify its object", he added that "it is necessary to watch a unity of language, and avoid any polysemy in legislative material" before concluding that "the vocabulary of texts has to judge itself in its clarity and precision". | ||
| 520 | |d Le droit et la langue sont indissociables et sont étudiés depuis longtemps, ils sont d’actualité aussi bien en Algérie qu’a l’étranger, en droit international ou en droit comparé, si le droit s’exprime par la langue, il a de plus en plus tendance à la régir, ce qui n’est pas sans conséquence pour les professionnels du droit et de la traduction. La linguistique juridique est l’étude du langage du droit, Jean- Louis-Bergel, dans son ouvrage sur la terminologie juridique, faisait observer que "Tout terme ou expression juridique doit désigner un concept et un seul, et cela comme une étiquette, pour identifier son objet", il ajoutait "Il faut veiller à une unité de langage et éviter toute polysémie en matière législative", avant de conclure que "Le vocabulaire des textes doit se juger à sa clarté et à sa précision". | ||
| 520 | |a إن اللغة والقانون تربطهما علاقة وطيدة، فلقد تمت دراستهما منذ زمن طويل بحيث ما زالت هذه الدراسات موضوع اهتمام في وقتنا الحاضر، سواء في الجزائر أو في الخارج، فـي القانون الدولي أو في القانون المقارن، فإذا كان التعبير عن القانون يتم بواسطة اللغة، فهو يميل إلى توجيهها والتحكم فيها، مما يؤثر على المتخصصين في مجال القانون وعلم الترجمة، حيث يتمثل علم اللسانيات في دراسة اللغة القانونية. لقد قرر جون لويز برغل في كتابه المنهجية القانونية، الصادر في سنة 2001 بأن كل مصطلح أو عبارة، يجب آن يحدد بمفهوم واضح هذا، كبطاقة تعريف لتحديد ماهية موضوعها، كما أنه يجب السهر على استعمال لغة واحدة لاجتناب تناقض المصطلحات، وأخيرا يختم قوله إنه يحكم على مصطلحات النصوص القانونية بمدى وضوحها وكيفية تحديدها. | ||
