المستخلص: ارتبط ظهور مصطلح الشفافية الإدارية بعدد من المفاهيم والمصطلحات القانونية الأخرى التي جرت الدراسات والأبحاث على محاولات المزج بين موضوعاتها المختلفة منذ ظهور المصطلح في ثمانينات القرن الماضي، فارتبط بمصطلح النزاهة، والحكم الرشيد، وحرية تداول المعلومات والإفصاح، والمساءلة، والفساد الإداري، ومصطلح الشفافية الإدارية العنصر الحاكم لهذه المصطلحات يعني انفتاح الحكومات على شعوبها، مما يرسخ لمبدأ الشرعية القانونية. وترجع أهمية البحث في توضيح الدور الذي يمكن أن تلعبه الشفافية الإدارية كآلية من آليات مكافحة الفساد، ووسيلة من وسائل علاجه. ولقد اتبعنا في دراستنا هذه عدة مناهج علمية، منها المنهج التاريخي للتأريخ للمفاهيم والمصطلحات القانونية التي تثيرها الدراسة، في محاولة لتتبع تطور المفهوم، والعلاقة بين المفهوم والمفاهيم المرتبطة بالدراسة، واتبعنا المنهج التحليلي لتحليل ماهية كل مصطلح والوقوف على خصائصه، ثم المنهج المقارن لفهم العلاقة بين المصطلحات المختلفة التي يثيرها البحث. ثم المنهج التطبيقي من خلال دراسة أحكام القضاء التي جاءت لتوضح هذه العلاقات المتشابكة، ونطاق العلاقات التي تربط بعض هذه العلاقات ببعض. وانتهينا في دراستنا لتبني عدد من النتائج: 1. لابد من الإسراع في إصدار تشريع ينظم الحق في الحصول على المعلومة وحرية تداول المعلومات يتوافق مع المعايير العالمية. 2. إعادة هيكلة التنظيم الإداري داخل الدولة، وتطبيق اللامركزية الإدارية، بما يسمح بتدفق المعلومات الإدارية بين مختلف المستويات الإدارية. 3. تبني الجهات الإدارية الحكومية لفكر النشر الاستباقي للمعلومات الخاصة بعملها على المواطنين. 4. تطبيق الدولة لفكرة الحكومة الإلكترونية تطبيقاً عملياً. تعد الدراسة دراسة فريدة من نوعها لربطها بين الشفافية الإدارية من ناحية والسر الوظيفي من ناحية أخري، والعلاقة بين الشفافية الإدارية ومكافحة الفساد الإداري.

Since its advent in 1980s, the term ‘administrative transparency’ has been associated with a host of other legal terms and concepts which researches attempted to combine their various topics. Administrative transparency has been associated with the terms: integrity, good governance, freedom of information and disclosure; accountability, administrative corruption and administrative transparency, the element governing the aforesaid terms, which indicates governments’ openness to their people to promote the principle of legality. This research threw the spotlight on the role of administrative transparency in the fight against corruption. Research adopted numerous scientific approaches, including historical one which was used to chronicle legal terms and concepts handled with a view to tracking their evolution as well as their correlations with pertinent ones. Research also adopted analytical approach for the analysis of each term and the examination of respective characteristics. Moreover, comparative, and applied approaches were also used: the former was used to understand the relationship between various terms, while the latter to study judicial rulings illustrating interrelationships and their scope. Research summed up with the following findings: 1. The need for a speedy enactment of a legislation regulating the right to access information and to freedom of information in conformity with international standards. 2. Restructuring administrative regulation and adopting administrative decentralization, thus allowing flow of information between various administrative levels. 3. Governmental administrative entities’ proactive dissemination of information specific to their work among people. 4. Practical application of E-Government. This study is unique as it creates a link between administrative transparency and job secrets, and explores the correlation between administrative transparency and the fight against administrative corruption.
