|a تصدر من الشخص في حال الصحة تصرفات منجزة تنفذ في جميع مال المتصرف سواء كانت لوارث أو لغير وارث بمقابل أو غير مقابل كالعقود التبرعية، فيجوز له أن يتبرع بكل أمواله أو بعضها، دون أن يكون لأحد الحق في مراجعته أو الاعتراض عليه، لأن ما يتصرف فيه هو خالص حقه، غير أن الشخص إذا كان مريضا مرض الموت تفرض على تصرفاته التبرعية قيودا، فبالنسبة للمريض مرض الموت فيقوم بتصرفات وتثبت عليه جميع الحقوق لغيره كالصحيح إلا أنه يمكن أن تكون هذه التصرفات مضرة للورثة والدائنين ولهذا السبب فرضت بعض القيود عليها، فمثلا فيما يخص تبرعات المريض مرض الموت كالهبة، الوقف وما يلحقها من التصرفات الأخرى، فتأخذ حكم الوصية مضافة إلى ما بعد الموت في نهايتها، أي أنه لا تنفذ إلا في حدود ثلث التركة، وما زاد عن ذلك يتوقف عن إجازة الورثة.
