وضعت التشريعات المدنية المختلفة تنظيماً قانونياً عاماً لحكم التصرفات التي تصدر عن المريض مرض الموت، ويكون مقصوداً بها التبرع، على خلاف مجلة الأحكـام العدليـة التـي تضمنت تنظيماً قانونياً خاصاً لهبة المريض مرض الموت. وعرفت بعض التـشريعات المدنيـة مرض الموت وحددت شروطه التي تحتاج إلى التحليل للوصول إلى معيار لما يعد مرض مـوت من عدمه. وهذا يظهر أن التنظيم القانوني لهبة المريض مرض المـوت يحتـاج إلـى الـشرح والتحليل، من حيث بيان ماهية مرض الموت، وما يدخل في إطاره من حـالات تأخـذ حكمـه، بالإضافة إلى حكم الهبة الواقعة فيه، وموقف التشريعات المختلفة من ذلك، لإزالة اللبس عما علق ببعض جوانب هذا الموضوع بهدف استقرار الأوضاع القانونية. وقد توصل البحث إلى تعريـف دقيق وشامل لمرض الموت، وإلى أن المعيار فيما يعد مرض موت من عدمه هو معيار شخصي، بالإضافة إلى ضرورة إجراء بعض التعديلات في مشروع القانون المدني الفلسطيني، وإلى وضع تنظيم قانوني خاص بهبة المريض مرض الموت في القانون المدني، بما يؤدي إلى حماية الورثة والدائنين.
The various civil legislations organized and placed a general legal system concerning the action issued by patient of death disease with full intention and focus on donation, unlike the Majalla which included special legal rule of death disease patient's grant/donation. Some civil legislation defined the meaning of death disease and its terms that need to be analyzed in order to reach a standard of what constitutes death disease or not. This shows that the legal system of death disease patient's donation requires explanation and analysis in term of identification of death disease and indicates what cases included within its context and take the same sentence, in addition to donation's rule included therein and various legislation's position thereof to remove the confusion that may suspended to some aspects of this topic in order to stabilize legal status. The research has come to precise and comprehensive definition of the disease death, and that the standard of what constitutes death disease or not is personal, as well as to the necessity to make some amendments in the draft Civil Law of Palestine, and to set a special legal legislation of the death disease patient's donation in the Civil Code, including lead to protect the heirs and creditors.
