المستخلص: Le dommage causé à l'environnement en temps de conflits armés soulève des difficultés et des problèmes majeurs. Ce dommage est difficile à cerner et à évaluer, car il ne se produit pas d’un coup. C’est un dommage significatif, durable et largement répandu, et par conséquent, il est difficile d'évaluer ses effets. L’évolution continue des armes utilisées dans les guerres a conduit à altérer l'environnement dans ses différentes composantes. C’est dans ce contexte que cette recherche vise à mettre en lumière la spécificité des dommages environnementaux causés par les conflits armés dans le cadre des dispositions du droit humanitaire international et les traités environnementaux internationaux conclus à cet effet.

يثير الضرر البيئي الذي يلحق بالبيئة زمن النزاعات المسلحة العديد من الصعوبات والمشاكل، حيث يصعب ضبطه، وتقديره فهو لا يتحقق دفعة واحدة كما أنه جسيم وواسع الانتشار وطويل الأمد، ومن ثم لا يمكن تقييم آثاره. ذلك بسبب حداثة الأسلحة المستخدمة في الحروب وتطورها مما أدى إلى المساس بالبيئة بمختلف مكوناتها. لذلك ارتأينا البحث في خصوصية الضرر البيئي الناجم عن النزاع المسلح وفقا لأحكام القانون الدولي الإنساني وللاتفاقيات الدولية البيئية المبرمة في هذا المجال.

The damage inflicted to the environment during armed conflicts evokes many difficulties and problems as being difficult to identify and estimate; it is because the damage does not occur immediately, but takes relatively a long time to spread and to be identified. Thus, it is difficult to assess its dangerous effects, particularly because of the unconventional weapons used in time of war that are continuously evolving. Therefore, this paper aims at studying the particularity of environmental damage in times of armed conflicts under the provisions of international humanitarian law and the international conventions related to the protection of the environment.
