المستخلص: ترجع الهجرة غير المشروعة إلى اختلال في التوازن الاجتماعي والاقتصادي والبطالة وعدم توفر فرص عمل حقيقية وانخفاض مستوى الأجور وغلاء الأسعار والفساد والاستبداد، وعدم الاستقرار السياسي، والصراعات المسلحة والحروب وانتشار الفقر والبطالة وتدهور الوضع الاقتصادي وعدم مقدرة الدولة على حماية حدودها. تنامي الطلب العالمي على العمالة غير القانونية الرخيصة... ضعف الوازع الأخلاقي والديني وانتشار الجريمة في المجتمع. عدم وجود قوانين رادعه... تطبيق النظام الاقتصادي الرأسمالي تحت شعارات الخصخصة… مما يؤدى إلى إضعاف دور القطاع العام خاصة ومؤسسات الدولة عامة، وفتح الحدود أمام المؤثرات الدولية دون تمييز بين المؤثرات الإيجابية (كالاستثمارات في مجالات الإنتاج) والمؤثرات السلبية التي سبق ذكرها. وبناء على كل ما ورد فإن هنالك خلاف بشأن ما إذا كان المهاجر غير الشرعي هل انه مجرم يستلزم معاقبته جنائيا؟ أم انه ضحية لتضليل الشبكات الإجرامية وللظروف المحيطة به وبالتالي يجب إسعافه وحمايته؟
للإجابة على هذا التساؤل ظهرت عدة نظريات
في النظرية الأولى ينظر إلى المهاجرين على انهم ضحايا وفئات ضعيفة يجب حمايتها، وعلى هذا الأساس وضعت سياسات مبنية على أسس حقوق الإنسان وقوانين اللجوء لضمان حماية المهاجرين المعرضين للخطر.
أما النظرية الثانية: فترى في المهاجر ذلك العامل الدؤوب إذ انه مفيد لدولة المقصد من خلال العمل الذي يؤديه فيها، كما انه مفيد لدولة المنشأ (الدولة التي هاجر منها) من خلال الحوالات المالية المرسلة إليها، وكذلك الاستثمارات التي يمكن أن يقوم بها عن طريق أهله وبعد عودته. (ومن الملاحظ أن أغلب السياسات المطالبة بالعفو عن المهاجرين المخالفين للقوانين المتعلقة بالهجرة وتنظيمها مستمدة من هذه الفكرة).
وبعد دراسة هذا الموضوع نرى انه يجب تغيير مفهوم الهجرة غير الشرعية من حيث الاسم والمضمون... وذلك لأن المسمى غير صحيح (الهجرة غير الشرعية) بل يجب تغييره إلى الهجرة غير القانونية، وذلك لأن الهجرة جائزة شرعا وقانونا، وهي دأب الأنبياء والرسل، فليس هنالك ما يدل على عدم مشروعيتها.


Illegal migration is caused by social and economic imbalance, unemployment, lack of real employment opportunities, low wage levels, high prices, corruption and tyranny, political instability, armed conflicts, wars, widespread poverty, unemployment, deteriorating economic situation, the inability of the State to protect its borders, growing global demand for cheap illegal labor, weakness of moral and religious reasoning and prevalence of crime in society, lack of laws to deter them, and implementing the capitalist economic system under the slogans of privatization, which leads to weakening of the role of the public sector in particular and State institutions in general, as well as opening borders to international influences without distinguishing between the positive influences (such as investments in production areas) and the above-mentioned negative ones. Based on all the above, there is a disagreement about whether the illegal migrant is a criminal who requires criminal punishment? Or is he a victim of misguided criminal networks and the circumstances surrounding him and, therefore, must be aided and protected?
There are several theories with reagard to answering the above question:
In the first theory, migrants are seen as victims and vulnerable groups to be protected; therefore, policies based on human rights and asylum laws have been developed to ensure the protection of migrants at risk.
The second theory is that the migrant is a diligent factor, as he is beneficial to the State of destination through the work which he will perform there. He is also beneficial to his country of origin (the country from which he emigrated) through money transfers he will send there and investments that he can make through his family and after his return. (Most policies demanding amnesty and regulation of migrants in conflict with immigration laws are derived from this idea.)
After studying this topic, we believe that the concept of illegal immigration should be changed in terms of name and content. The name (non-Shari' immigration) is not correct, and it must be changed to "illegal immigration" because immigration is permissible legally and in Shariah as well. It has been consistently carried out by the prophets and messengers, and there is no proof that indicates its illegality.
