المستخلص: تعتبر البيئة من أهم نعم الله علينا، وبالتالي يتعين على أصحاب الضمير الحي الدولي بأن يسخروا كل الإمكانيات اللازمة للحفاظ على البيئة وبذل ما في جهدهم من أجل الحفاظ عليها، وهو ما يوجب على كل أشخاص القانون الدولي ببذل كل الجهود الدولية اللازمة خاصة خلال العمليات العسكرية بأن تكون البيئة خارج هذه العمليات، فلا يجوز استهدافها أو جعلها هدفاً عسكرياً، وبالتالي حظر كل فعل من شأنه أن يمثل اعتداء على البيئة بكل مكوناتها وعناصرها الحيوية. فالحروب التي عبرت عن أنانية الإنسان ورغبته في التملك جعلته يعاني من ويلات ومآسي الحروب والنزاعات المسلحة الدولية وغير الدولية، وجعت منه أداة للدمار والخراب، وهذا القول نعتبره حقيقة واقعية كون أن الحرب لا تفرق بين المنتصر والمنهزم خاصة في مجال البيئة، فطبيعة الإنسان التي جبل عليها تجعله ينظر إلى المصلحة الآنية دون الاهتمام بالخطر المستقبلي، فنتائج الاعتداء على البيئة تكون مستقبلية لا تظهر آثارها على الفور بل تظهر بعد حين، من خلال ملاحظة التغير في الطقس، أو في طبقة الأوزون، أو في جفاف الأنهار والأودية.... إلخ. وعليه فإن دمار البيئة هو تدمير للحياة البشرية جمعاء، وإخلال بالتوازن البيئي الذي خلقه الله سبحانه وتعالى، حيث سخر هذا الكون لخدمة الإنسان وجعله صالحاً لكل زمان ومكان، وما نشهده اليوم من تغيرات مناخية ضارة بالإنسان وغيره من موجودات لخير دليل على آثار هذه الحروب المباشرة وغير المباشرة.

The environment is considered one of the most important blessings of God on us, and therefore the people of the international conscience must harness all the necessary capabilities to preserve the environment and do their best to preserve it, which is what requires all persons of international law to exert all the necessary international efforts, especially during military operations that the environment is outside these operations. It is not permissible to target it or make it a military target, and therefore prohibiting any action that would constitute an attack on the environment with all its vital components and elements. The wars that expressed the human being’s selfishness and his desire to possess made him suffer from the ravages and tragedies of wars and international and non-international armed conflicts, and made him a tool for destruction and devastation, and this saying we consider it to be a realistic fact, since the war does not differentiate between the victor and the defeated, especially in the field of the environment. The person who has been overlooked makes him look at the immediate interest without paying attention to the future danger. The results of the aggression on the environment are futuristic, and their effects do not appear immediately, but appear after a while, by observing the change in weather, the ozone layer, or the dryness of rivers and valleys. ...etc. Therefore, the destruction of the environment is the destruction of human life as a whole, and a violation of the environmental balance created by God Almighty, as this universe mocked the service of man and made it fit for every time and place, and what we are witnessing today are climate changes harmful to man and other assets for good evidence of the effects of these direct wars And indirect.
