المستخلص: يضطلع مرفق الأمن الوطني بوظيفة الحفاظ على الأمن والنظام العام داخل الدولة، ومن هذا المنطلق فإنه يتمتع بسلطة واسعة في إبعاد كل أجنبي يقدر في سلوكه أو سوابقه أو مجرد وجوده تهديدا لأمن الدولة، ويستمد مرفق الأمن هذه السلطة من مبدأ سيادة الدولة على أراضيها وحقها في حماية أمنها وكيانها من الخطر الذي يمكن أن يشكله الأجانب عليها، إلا أن هذا الارتباط لا يجعل سلطة الإبعاد مطلقة، حيث حرص المشرع الجزائري على إحاطة هذا الإجراء بجملة من الشروط والآليات التي تضمن الموازنة بين أمن الدولة وسيادتها من ناحية، وبين حريات الأجانب وحقهم في التنقل من ناحية ثانية، ويتولى القضاء الإداري الرقابة على احترام مرفق الأمن لهذه الموازنة عند ممارسته لسلطة الإبعاد.

Dans le cadre du service public, les services de sécurité veillent à la préservation de la sécurité et de l’ordre public, à partir de là, ces services détiennent de larges prérogatives dans l'éloignement de tout ressortissant étranger quand sa conduite; ses antécédents; ou même sa présence sont jugés comme constituons une menace à la sécurité de l'Etat hôte. Le service de sécurité puise cette autorité et ce pouvoir du principe de la souveraineté exercée par l'Etat sur son territoire et de son droit de préserver sa sécurité et son entité du danger que pourrait constituer les étrangers s’y trouvant. Néanmoins ce pouvoir de l’éloignement n’est pas absolu, le législateur algérien à veiller à l’encadrer et le restreindre et c’est en composant le respect de certaines procédures et condition de fonds. Ces contraintes juridiques tendent à créer un équilibre entre les nécessités de la sécurité nationale et l’exercice de la souveraineté d’un côté, et le droit et les libertés des étrangers d’un autre. L’ordre juridictionnel administratif veille à la bonne interprétation et application de cette équation.

The National Security Agency undertakes the function of maintaining security and public order within the country. From this point of view, it has a wide authority to throw out every foreigner who is deemed in his behavior, precedents, or mere existence to be a threat to the security of the state. The security agency derives this authority from the principle of state sovereignty over its lands and its right to protect its security and entity from the danger that foreigners may pose to it. However, this link does not make the authority of deportation absolute, as the Algerian legislator was keen to include this procedure with a set of conditions and mechanisms that guarantee a balance between the state’s security and sovereignty on the one hand, and between the freedoms of foreigners and their right of movement on the other hand.
