المستخلص: الصفقات العمومية تعد عقودا ترد على المال العام منح لها المشرع حماية جنائية خاصة، من وقت تحضيرها حتى تاريخ نهاية تنفيذها بتسليم شهادة إنجاز الخدمة. تجسدت هذه الحماية بتجريم الامتيازات الغير مبررة التي يقدمها الموظف للمتعامل مع الدولة وتجريم رشوة الموظف الجزائري وكذا رشوة الموظف الأجنبي. غير أن المشرع الجزائري قرر إعادة تكييف أهم هذه الجرائم من جناية إلى جنحة مشددة من أجل تفعيل قمع الفساد في مجال الصفقات العمومية، كما أنه من ناحية أخرى أخضع جرائم الفساد في مجال الصفقات العمومية لإجراءات جزائية خاصة كالتسرب والمراقبة الإلكترونية وخصص لها محاكم استثنائية مخالفا بذلك الأحكام العامة لإجراءات المتابعة والمحاكمة الجزائية.

Les marchés publics sont des contrats ayant pour objet le bien public. Le législateur algérien leurs accorde une protection spéciale à partir de leurs préparations jusqu’à leurs exécutions par l’attestation de service fait. Cette protection se concrétise par l’incrimination des privileges non justifiées qu’accorde le fonctionnaire aux opérateurs, et l’incrimination de la corruption du fonctionnaire algérien et la corruption du fonctionnaire étranger. Cependant le législateur algérien a décidé de requalifier les plus importantes incriminations en délits aggravés pour l’efficacité de la répression de la corruption dans le domaine des marchés publics. D’autre part, le législateur a soumis les infractions à des procédures de poursuite et de jugement exceptionnelles tel que l’infiltration et le contrôle électronique.Comme il a été institué pour ces infractions des tribunaux d’exception contrairement aux règles générales des poursuites et des jugements.

Public transactions are contracts for which public money has been granted special criminal protection by the legislator, from the time they are prepared until the end of their execution by handing over a certificate of completion of the service. This protection has been embodied in the criminalization of unjustified privileges provided by an employee to a client with the State and the criminalization of bribery of an Algerian employee as well as the bribery of a foreign employee. However, the Algerian legislator decided to readapt the most important of these crimes from a felony to an aggravated misdemeanor to activate the suppression of corruption in public transactions. On the other hand, corruption offenses in the field of public transactions have been subject to special criminal procedures such as penetrating and electronic surveillance.
