الحمد لله وحده، والصلاة والسلام على من لا نبي بعده، نبينا محمد وعلى آله وصحبة ومن والاه، واتبع هداه إلى يوم الدين، وبعد: اهتمت الشريعة الإسلامية بقضية الأمن والأمان في المجتمع، وشرعت القوانين والأحكام، وحذرت من ترويع الأمنين وإرهابهم، وجرمت إنشاء المواقع الإرهابية على شبكة الأنترنت لما لها من دور خطير في نشر الأفكار الإرهابية التي تؤدي إلى زعزعة الأمن الدولي. وجريمة إنشاء المواقع الإرهابية الإلكترونية أصبحت من القضايا الهامة والخطرة عالميا، وخصوصا مع تطور التكنولوجيا، وازدياد خطورة تهديدها للأمن الدولي. ونظرا لخطورة المواقع الإرهابية الإلكترونية، فقد صدرت في المملكة العربية السعودية أنظمة ولوائح وتعليمات وقرارات لمواجهة الاعتداءات الإلكترونية الإرهابية، ونصت تلك الأنظمة على عقوبات صارمة لردع المجرمين والمخالفين. ولإيضاح وبيان موضوع هذا البحث، فإني قسمته إلى مقدمة وخمسة مباحث وخاتمة: المبحث الأول: خطورة الاعتداء على أمن الدولة، وبيان أهم المصطلحات، وفيه ثلاثة مطالب: المطلب الأول: بيان المصطلحات الهامة الواردة في البحث. المطلب الثاني: خطورة الاعتداء على أمن الدولة في الشريعة الإسلامية. المطلب الثالث: خطورة إنشاء المواقع الإرهابية على الأمن الدولي. المبحث الثاني: جريمة إنشاء المواقع الإرهابية الإلكترونية، وتحديد أمن الدولة في النظام السعودي. المبحث الثالث: أركان جريمة إنشاء المواقع الإرهابية الإلكترونية، وفيه ثلاثة مطالب: المطلب الأول: الركن القانوني لجريمة إنشاء المواقع الإرهابية الإلكترونية. المطلب الثاني: الركن المادي لجريمة إنشاء المواقع الإرهابية الإلكترونية. المطلب الثالث: الركن المعنوي لجريمة إنشاء المواقع الإرهابية الإلكترونية. المبحث الرابع: جريمة إنشاء المواقع الإلكترونية وخطورتها على الأمن الداخلي للدولة في الشريعة الإسلامية والنظام السعودي، وفيه مطلبان: المطلب الأول: جريمة إنشاء المواقع الإلكترونية وخطورتها على الأمن الداخلي للدولة في الشريعة الإسلامية. المطلب الثاني: جريمة إنشاء المواقع الإلكترونية وخطورتها على الأمن الداخلي للدولة في النظام السعودي. المبحث الخامس: جريمة إنشاء المواقع الإلكترونية وخطورتها على الأمن الخارجي للدولة في الشريعة الإسلامية والنظام السعودي، وفيه مطلبان: المطلب الأول: جريمة إنشاء المواقع الإلكترونية وخطورتها على الأمن الخارجي للدولة في الشريعة الإسلامية. المطلب الثاني: جريمة إنشاء المواقع الإلكترونية وخطورتها على الأمن الخارجي للدولة في النظام السعودي. سائلا الله عز وجل التوفيق والسداد في دراسة هذا الموضوع العلمي إنه ولي ذلك والقادر عليه، والحمد لله أولا وأخيرا.
Praise be to God, and prayers and peace be upon the one after whom there is no prophet, our Prophet Mohammed, and his companions, who followed him until the Day of Judgment. Islamic law has taken care of the security and safety of the community, initiated laws and rules, warned against terrorism, and criminalized the establishment of terrorist websites on the Internet because of its dangerous impact in spreading terrorist ideas that lead to the destabilization of international security. The crime of creating terrorist websites has become an important and dangerous issue worldwide, mainly with the development of technology and the emergent risk of its threat to international security. Due to the significance of terrorist websites, regulations, instructions and resolutions have been issued in Saudi Arabia to counter terrorist attacks, and these regulations have provided strict penalties to deter criminals and violators. In order to clarify the subject of this research, the researcher has divided this research into an introduction, fifth topics and a conclusion: The first topic: the seriousness of attacking the security of the country in Islamic law and the most important terms of the research, the following points are required; The first point: the most important terms of the research. The second point: the seriousness of attacking the security of the country in Islamic law. The third point: the danger of establishing terrorist websites on the international security. The second topic: the crime of creating terrorist websites and threatening the security of the country in the Saudi system. The third topic: Elements of the crime of creating terrorist websites, the following points are required; The first point: The legal element of the crime of creating terrorist websites. The second point: The material element of the crime of creating terrorist websites. The third point: The moral pillar of the crime of creating terrorist websites. The fourth topic: the crime of creating websites and their danger on the national security of the country in Islamic law and the Saudi regime as well.
