المستخلص: رأس المال جبان خاصة أن الاستثمار هو التضحية بقيم حالية لتحقيق فوائد مستقبلية، يحكما عنصر المجازفة، هذا الأمر يحتم على كل الدول أن تضمن في تشريعها مسألة الأمن التشريعي والقانوني، باعتبار من أساسيات المناخ الاستثماري. ولتطوير وحماية الاستثمار وجب توفير مناخ مشجع في ضوء نظام سياسي مستقر وآمن وذلك بتوفير الأمن القانوني والتشريعي، الذي هو الركيزة الأساسية لاتخاذ القرار الاستثماري ومن أهم العناصر لتحقيق استثمار شامل الذي ينعكس إيجابا على إثراء القطاع واستقطاب المستثمرين من مختلف أنحاء العالم، وتتحقق حماية الاستثمار بتوفير الأمن القانوني كون أن هذا الأخير مقوما هاما من مقومات المناخ الاستثماري في أي بلد من بلدان العالم، لأن عملية توفير عنصر الثبات التشريعي والأمن والطمأنينة والهدوء للمستمر في هذا المجال من لحظة وصوله إلى البلد حتى شروعه في المشروع والبدا في تنفيذه. وتتجلى أهمية هذه الدراسة كونها تسلط الضوء على الدور الأساسي الذي يلعبه الاستقرار القانوني التشريعي في اتخاذ القرار الاستثماري، ولما للأمن القانوني من ضمانات للمستمر الحلي والأجنبي، من هذا المنطلق تكون إشكالية هذه الورقة البحثية: ما هي الضمانات القانونية والتشريعية الممنوحة للمستثمر وفق نظر المشرع الجزائري؟

Capital is cowardly, especially as investment is sacrificing current values to achieve future benefits, governing the element of risk. This matter requires all countries to guarantee in their legislation the issue of legislative and legal security, considering the basics of the investment climate. In order to develop and protect investment, an encouraging environment must be provided in the light of a stable and secure political system by providing legal and legislative security, which is the main pillar of investment decision-making and one of the most important elements to achieve a comprehensive investment that reflects positively on enriching the sector and attracting investors from all over the world. Protection of investment is achieved by providing security It is legal that the latter is an important component of the investment climate in any country in the world, because the process of providing an element of legislative stability, security, tranquility and calm for the continuous in this field from the moment of its arrival to the country until it commences the project and begins its implementation. The importance of this study is evident as it sheds light on the fundamental role that legal and legislative stability plays in making the investment decision, and because of the legal security guarantees for the local and foreign investors, in this sense the problem of this research paper is: What are the legal and legislative guarantees granted to the investor according to the Algerian legislator?
