تأقيت الوقف بمدة معينة يزول بعدها أجازه أبو يوسف، وهو المعتمد من مذهب المالكية، ووجه عند الشافعية والحنابلة، ومنعه فريق من الفقهاء حيث رأوا أن الوقف لا يكون إلا مؤبدا، فلا يجوز تأقيته بمدة معينة، وهو مذهب جمهور الحنفية وبعض المالكية، وهو مشهور مذهب الشافعية والحنابلة، وهو مقتضي قول ابن حزم، والوقف المؤقت يتصور في وقف الأعيان مدة من الزمن أو لتحقيق غاية وقتية ينحل الوقف بعدها، كما يتصور في وقف منافع أعيان الأموال، ومنافع الإنسان سواء كان مستأجرا للقيام بها أو كان عملا يؤديه الواقف لها، ولا يخفي ما يحققه هذا النوع من الوقف من زيادة عدد الواقفين، وما يستتبعه ذلك من زيادة عدد المنتفعين به، وتحقيق مبدأ التكافل الاجتماعي الذي هو من مبادئ الإسلامية السامية، وتحقيق الكفاية والوفرة بالنسبة لبعض ضرورات الحياة وحاجياتها لقطاع كبير من أفراد المجتمع، وتخفيف العبء عن كاهل الدولة التي تطالب دائما بالوفاء بحاجات المجتمع الضرورية وإلحاجيه، وتوفير كثير من بنود ميزانيتها لتوجه إلي أغراض أخر يتحقق بها صلاح المجتمع والأمة، كما يعمق روح الانتماء والترابط والتآزر بين أفراد المجتمع، وتلك غايات مشروعة تتحقق من خلال هذا النوع من الوقف.
