المستخلص: "تأخر البيان وأثره عند الأصوليين": من الموضوعات الهامة في أصول الفقه؛ وقسمت البحث إلى: مقدمة وتمهيد وفصلين وخاتمة، وكان من الضروري أن يتضمن البحث تعريف البيان وأركانه وأنواعه ومراتبه وطرقه سواء أكانت بالفعل أم القول فيما إذا تعارضا مع بيان المطلق بالمقيد والبيان بالأدنى والتعبد بالمجمل قبل البيان، والشريعة الإسلامية لم تثقل على الناس بأحكام لا يفهمونها وإنما ضبطت المفاهيم؛ لمعرفة المقصود من التشريع، والتكليف به، أما الخطاب بالمجمل فإنه مفيد للابتلاء لاعتقاد كونه حقا مع انتظار البيان، وكان بديهيا أن يكون بين العلماء بعض الاختلافات حول مسألتين هامتين تدوران حول هذا الموضوع الأولى منهما تأخير البيان عن وقت الحاجة، وهو: الوقت الذي يحتاج فيه المكلف البيان؛ ليتمكن من الامتثال بحيث لو تأخر البيان عنه لم يتمكن المكلف من العمل الموافق لمراد الشرع، وهو خلاف مبني على جواز التكليف بما لا يطاق، والثانية تأخير البيان إلى وقت الحاجة، وهو وقت وجوب العمل، وقد بحث الأصوليون موضوع تأخير المخصص كفرع لتأخير البيان باعتبار أن البيان فيه إيضاح للنص المبلغ. هذا وقد ناقشت ما سبق مع الأدلة والترجيح.

"The delayed statement and its impact on the fundamentalists": Among the important topics in the principles of jurisprudence; the research was divided into: introduction، preliminary, chapters, and a conclusion. It was necessary for the research to include the definition of the statement, its elements، types، ranks and methods, whether it was actual or saying whether they conflicted with the statement of the absolute in the chains and the statement in the minimum and the worship in general before the statement. Islamic law was not burdened with people with provisions they did not understand، but concepts were set to know what was meant by the legislation، and to assign it to it. As for the speech in general, it is useful for misfortune to believe that it is a right while awaiting the statement. It is: the time when the taxpayer needs the statement, to be able to comply so that if the statement is late، the taxpayer is not able to work in accordance with the law’s intention, which is a dispute based on the permissibility of assigning unbearable. It is a dispute based on the permissibility of commissioning unbearable، and the second is delaying the statement until the time of need, which is the time when work is required. Fundamentalists discussed the issue of delaying the allocation as a branch of delaying the statement, considering that the statement contains clarification of the reported text. This has been discussed the above with evidence and weighting.
