المستخلص: إن الأصوليين، وفي طليعتهم أصوليو المتكلمين قد أعطوا عناية خاصة بدلالة مفهوم المخالفة على الأحكام الشرعية، وتوسعوا في الحديث عنها، وعن أنواعها، حتى يتمكنوا من فهم النصوص الشرعية، وكشف أسرارها، ومعرفة المراد منها، وقد وضعوا شروطاً، وضوابط للعمل بمفهوم المخالفة، واعتباره طريقاً من طرق استنباط الأحكام الشرعية، رداً بذلك على اعتراضات للنافين من الحنفية، والظاهريين، والقلة من المتكلمين للعمل بمفهوم المخالفة. فتبين بذلك من عمل أكثر أصوليي المتكلمين بمفهوم المخالفة مدى عمقهم في فهم النصوص الشرعية عن طريق معرفة وضع الألفاظ لمعانيها في الأساليب العربية. وقد ترتب على هذا الخلاف أثر كبير في الفقه، وقواعد الأصول التي تنبني على العمل بمفهوم المخالفة، واعتباره طريقاً من طرق استنباط الأحكام الشرعية، مما دفعني في الكتابة في هذا البحث، وقد قسمته إلى مقدمة، وتمهيد، وفصلين، وخاتمة. أما المقدمة: فتشتمل على أهمية الموضوع، وأسباب اختياره. وأما التمهيد: ففي كيفية استفادة المعنى من ألفاظ النصوص الشرعية. وأما الفصل الأول: ففي الخلاف الأصولي في حجية مفهوم المخالفة، وأقسامه، ويشتمل على ثلاثة مباحث: المبحث الأول: في تعريف مفهوم المخالفة، وأسمائه عند الأصوليين. المبحث الثاني: في حجية مفهوم المخالفة، ومدى اعتباره عند الأصوليين. المبحث الثالث: أقسام مفهوم المخالفة بين المثبتين والنافين، والمقارنة بينهما في ذلك. وأما الفصل الثاني: ففي الأثار المترتبة على خلاف الأصوليين في الاحتجاج بمفهوم المخالفة، ويشتمل على مبحثين: المبحث الأول: الأثار الأصولية المترتبة على خلاف الأصوليين في الاحتجاج بمفهوم المخالفة. المبحث الثاني: الأثار الفقهية المترتبة على خلاف الأصوليين في الاحتجاج بمفهوم المخالفة. وأما الخاتمة: فتشتمل على نتائج البحث.

The Jurisprudents, and on the forefront of the Jurisprudents, the speakers, has given special attention to the significance of the concept of the violation on Sharia provisions ,and expanded to talk about it and its types, so that they can understand the Sharia scripts, reveal their secrets, and know what is meant by these Sharia scripts, and they have set conditions and controls to work on the concept of the violation, and consider it one of the ways to Inference the Sharia provisions in response to the objections of the Hanafi’s, Zharie’s and the few speakers to work on the concept of the violation. It turned out that one of the most Jurisprudents work with the speakers over the concept of the violation in their depth understanding of Sharia scripts by knowing the status of words to their meanings, Arabic Language methods, and the secrets of the statement in the rhetorical methods. This disagreement had a great impact on jurisprudence, and the rules of the jurisprudence that are based on working with the concept of violation, and considering it as a way to derive Sharia rulings, which prompted me to write in this research, and I divided it into an introduction, a preamble, two chapters, and a conclusion. As for the introduction: it includes the importance of the topic and the reasons for choosing it. As for the preamble: How to use the meaning of the words of the legal texts. As for the first chapter: In the jurisprudence dispute regarding the authenticity of the concept of violation, and its sections, it includes three topics: First topic: defining the concept of violation, and its names among the Jurisprudents. Second topic: on the authenticity of the concept of violation, and the extent to which it is considered by Jurisprudents. Third topic: sections of the concept violation between who confirmed it and who denied it and the comparison between them. As for the second chapter: In the implications of the Jurisprudents ’disagreement in protesting the concept of the violation, it includes two topics: First topic: the fundamental effects of the Jurisprudents ’dispute on invoking the concept of violation. Second topic: The doctrinal implications of the Jurisprudents ’dispute in invoking the concept of violation. As for the conclusion: it includes the search results.
