المستخلص: لا خلاف بين الأصوليين في جواز النسخ عقلا وشرعا، وكذلك في جواز تخصيص العام؛ ولكن الخلاف وقع في بعض مسائل وجزئيات النسخ والتخصيص، ومن بينها ما إذا تعارض النص العام مع النص الخاص، وكان الخاص متأخرا، فعند جمهور الحنفية يعد ذلك نسخا بخلاف جمهور الأصوليين الذين قالوا بالتخصيص. فما هو النسخ الجزئي، وهل ترتب على الخلاف في هذه المسألة خلاف أصولي، أو خلاف أصولي فقهي، أم أنه مجرد اختلاف مسميات وألفاظ؟، وخطة البحث: مقدمة، ومبحثان خصص الأول للتعريف بالنسخ، والنسخ الجزئي، وحكمهما وشروطهما والفرق بينهما، أما الثاني فقد خصص لمذاهب الأصوليين في هذه المسألة وأدلتهم، ومنشأ الخلاف في المسألة، وأخيرا الأثر المترتب على الخلاف في هذه المسألة. منشأ الخلاف في المسألة: يعود إلى مسألتين مهمتين، وهما: تأخير البيان، وماهية التخصيص. أهم نتائج البحث: النسخ الجزئي لا يختلف عن النسخ الكلي، إذ ماهية النسخ واحدة، وإنما الاختلاف في الموضع، والتسمية للتمييز فقط، وتردد المسألة بين التخصيص والنسخ مبني على أدلة عند كل فريق، والرأي الراجح هو: القول بالتخصيص في هذه الحالة؛ لوجاهة أدلته. واكتسبت المسألة أهمية لترتب الأثر الأصولي الحقيقي على الخلاف فيها.

The difference between the fundamentalists in the possibility of transcription is reasonably and legitimate, as well as the allocation of the general, but the difference occurred in some matters and the partialities of transcription and allocation. The disagreement origin in this matter: It is due to two important matters: delaying the statement and what is the allocation. The most important search results: Partial transcription does not differ from the total transcription, so what is transcription one. Difference in position and designation are for distinction only. The matter arises between allocation and transcription based on its priority for each team. The most preponderate opinion is to say allocation in this case. The matter gained importance for the real fundamental impact of the its dispute.
