المستخلص: موضوع البحث: يدور حول بيان حكم دخول الكفار وعمارتهم للمسجد الحرام ومساجد الحل. دراسة فقهية مقارنة معاصرة. أهداف البحث: بيان المقصود بالكفار، وذكر المراد بالمساجد والحرم، ومعرفة حكم دخول الكفار للمسجد الحرام، وحكم دخول الكافر لمساجد الحل، وتوضيح العمارة المتعلقة بالمساجد، والتعرف على الحكم الشرعي المتعلق بالاستعانة بالكفار في عمارة المساجد وصيانتها. منهج البحث: استقرائي. أهم النتائج: المراد بالكافر هو كل من انتفى الإيمان عنه سواء كان من أهل الكتاب أو المشركين، والمسجد هو كل موضع يتعبد الله فيه، وحرم مكة هو ما أطاف بها من جوانبها، وله حدوده الشرعية التي جاءت بها السنة، ولا يجوز دخول الكفار الحرم مطلقا، بما فيه المسجد الحرام، بل يجب منعهم منه، ولا يجوز دخول الكفار مساجد الحل إلا لحاجة أو مصلحة، ويحرم الاستعانة بالكفار لعمارة المساجد أو صيانتها ونظافتها، إلا إذا لم يوجد مسلم يقوم بذلك، أو كان الكافر أتقن صنعة من المسلم، أو أقل تكلفة منه، ويكون تحت إشراف مسلم. أهم التوصيات: ينبغي على المسلمين الاعتناء بالمساجد فيما يتعلق بالصيانة، فالبناء وحده دون الصيانة، يعتبر تفريطا للأوقاف، وعلى الجهات المسؤولة الحرص على استقدام العمالة الجيدة فيما يتعلق بالبناء أو الصيانة، ولا ينظر إلى الأقل تكلفة فقط، بل مراعاة الإتقان أولى.

Research Objectives: Explaining what is meant by infidels, mentioning what is meant by mosques and sanctuaries, knowing the rule of infidels entering the Sacred Mosque, the ruling on infidel entering mosques of the solution, clarifying architecture related to mosques, and identifying the legal ruling regarding the use of infidels in building and maintaining mosques. Research method: Inductive. The most important results: What is meant by a disbeliever is everyone who has no faith in him, whether it is the people of the book or the polytheists, and the mosque is every place where God is worshiped, and the sanctuary of Mecca is what circumvented it from its aspects, and it has its legal limits that the Sunnah brought, and it is not permissible to enter the infidels It is absolutely forbidden, including the Sacred Mosque, but rather they must be prevented from it, and it is not permissible for infidels to enter the solution mosques except for need or interest, and it is forbidden to use infidels to build or maintain mosque mosques, unless there is no Muslim doing this, or if the infidel has mastered the workmanship of a Muslim, or It is less expensive than him, and it is under Muslim supervision. The most important recommendations: Muslims should take care of the mosques with regard to maintenance, as building alone without maintenance is considered an endowment for endowments, and the responsible authorities should ensure that good labor is brought in with regard to construction or maintenance, and the least cost is not only seen, but rather consideration of mastery first.
