|a يعد موضوع الحق في الصورة من المواضيع التي تمس حياة الإنسان وخصوصياته، وقد ساعد التقدم العلمي في مجال التصوير على تعدد صور الاعتداء على الحق في الصورة، لذا فإن التطور الذي نعيشه اليوم وما نتج عنه من توظيف معلوماتي، وانتشار لعدد هائد من المنظمات الحكومية وغير الحكومية، وكذلك تعدد وسائل التواصل الاجتماعي وسهولة استخدامها، كل ذلك كان له تأثير كبير على حماية الإنسان لحقه في الصورة، حيث إن الاعتداء على هذا الحق يستوجب الحكم بالتعويض للشخص المعتدي على صورته، كما يجب أن تكون هناك عقوبات جزائية لتكون عامل ردع يمنع من الاعتداء على الحق في الصورة، إلا أن النقص في التشريعات العراقية، نتج عنه عدم توفير حماية قانونية كافية للشخص المعتدى على حقه في الصورة. بينما نرى أن المشروع الفرنسي قد عالج أحكام هذا الحق بنصوص قانونية في أكثر فرع من فروع القانون.

Requires a ruling for compensation for the person whose image is attacked, and there must be penal sanctions to act as a deterrent factor that prevents the assault on the right to photograph, but the deficiency in Iraqi legislation resulted in the failure to provide adequate legal protection for the person violating his right to photograph, while we see that the French legislator has dealt with the provisions of this right with legal texts in more branches of law.
