المستخلص: تناولت في هذا البحث المصطلحات الفقهية المستخدمة في مضمونه كالإجهاز والجريح ومعنى الأسير ومعنى الحرب وغيرها، وتناولت عند الحديث عن مضمونه، آداب القتال أثناء المعركة وقتال المشركين والكفار والإجهاز على جريحهم، وقتال أهل البغي، والإجهاز على جرحاهم، وتناولت بالتفصيل آراء الفقهاء في الإجهاز على جريح البغاة، وذكرت الأدلة لكل رأي مع المناقشة والترجيح، كما تناولت مسألة الإجهاز على جرحى الخوارج، وعبارات الفقهاء في اعتبارهم بغاة يأخذوا أحكامهم، ومن ثم تحدثت عن الإجهاز على الجريح في القانون الإنساني الدولي، والقانون الدولي لحقوق الإنسان، حيث تناولت حماية الجرحى والمرضى في القانون الولي الإنساني، وإعادة الجرحى والأسرى إلى الوطن مباشرة وإيواؤهم في بلد محايد، وفصلت في بعض الموضوعات، كالإبقاء على الحياة، وتحدثت عن بعض المبادئ التي يجب مراعاتها أثنا النزاعات المسلحة، من أجل حماية الأشخاص المحميين ومبدأ المعاملة الإنسانية، والجرحى والمرضى في الميدان، وأوردت آراء بعض المحدثين في معاملة الجرحى والإجهاز عليهم، وأخيرا مبدأ مراعاة القواعد الإنسانية في معاملة الأعداء.

In this research, I dealt with the Islamic jurisprudence terms used in its content, such as (Ijhaz (Killing the wounded) and wounded, the meaning of prisoner and war, etc. While discussing its content, I dealt with the etiquette of fighting during the battle, fighting the infidels and non-believers, killing their wounded, and fighting transgressors and killing their wounded. I also dealt, in detail, with the opinions of Fuqaha on the killing of wounded from among the aggressors. I mentioned evidence for each opinion with discussion and giving preference to (one opinion). I also discussed the matter of killing the wounded of Al-Khawarij (Kharijites), and the statements of Fuqaha in considering them as aggressors who will be subjected to the same provisions. I then talked about killing the wounded in international humanitarian law and international human rights law, where I discussed the immunity of the wounded and the sick in international humanitarian law, the immediate repatriation of the wounded and the prisoners, and providing them with shelter in a neutral country. I also elaborated on issues such as survival and talked about some principles that must be observed during armed conflicts in order to protect the protected persons and the principle of humane treatment, the wounded and sick on the ground. I mentioned the views of some scholars of Hadith on the treatment of the wounded and killing them, and finally, the principle of respecting humanitarian norms in the treatment of enemies.
