المستخلص: يدور موضوع هذه المقالة البحثية ويرتكز محورها حول بيان دور واختصاص مجلس الشيوخ في النظام الدستوري المصري بوصفه الغرفة الثانية للبرلمان، وأهمية عودته للحياة النيابية في مصر في ذلك التوقيت، وقد أستهدف ذلك البحث بيان أسباب إلغاء مجلس الشورى السابق مع بيان لمحة تاريخية عنه ودواعي استرجاعه مجلسا للشيوخ، إضافة إلى توضيح اختصاصات مجلس الشيوخ التي وضعها المشرع وطبيعة العلاقة بينه وبين مجلس النواب.
وفي ضوء ذلك قسمنا هذه المقالة البحثية إلى ثلاث محاور تعرضنا في المحور الأول: لأسباب إلغاء مجلس الشورى ودواعي استرجاعه مجلسا للشيوخ، وتعرضنا في المحور الثاني: لاختصاصات مجلس الشيوخ خاصة أن دور مجلس الشيوخ استشاريا وليس تشريعيا، كما تعرضنا في المحور الثالث: لبيان طبيعة العلاقة بين مجلس الشيوخ ومجلس النواب.
وقد انتهينا في هذا البحث إلى عدة نتائج أهمها: أن استحداث مجلس الشيوخ المصري من خلال التعديلات الدستورية لعام 2019 ما هو إلا لتحقيق التوازن والاستقرار السياسي والتشريعي واستكمال البنية التشريعية داخل الدولة ومعاونة مجلس النواب في المجال التشريعي، أيضا العلاقة بين مجلس الشيوخ ومجلس النواب ما هي إلا علاقة تعاون وتكامل لإثراء الحياة النيابية في مصر، كما أن مجلس الشيوخ يمثل تطورا إيجابيا نحو مزيد من النقاش الديمقراطي والتحليل العميق للظواهر والقضايا التي يكتمل حلها عبر تشريعات كفء ذات جودة وفاعلية.


The topic of this research article addresses focuses on clarifying the role and competence of the Senate in the Egyptian constitutional system as the second chamber of parliament, and the importance of its return to parliamentary life in Egypt at that time. This research aimed at explaining the reasons for the abolition of the former Shura Council with a historical overview of it and the reasons for its restoration as Senate in addition to clarifying the functions of the Senate that the legislator has established and the nature of the relationship between it and the House of Representatives.
In light of this, we divided this research article into three topics . The first topic addresses the reasons for canceling the Shura Council and the reasons for restoring it as a Senate. The second axis discusses the powers of the Senate, since the role of the Senate is advisory and not legislative. The third topic clarifies the nature of the relationship between the Senate and the House of Representatives.
In this research we have concluded with several results, the most important of which are: The creation of the Egyptian Senate through the constitutional amendments of 2019 represents a political and legislative balance and stability, a completion to the legislative structure within the state and an assistance to the House of Representatives in the legislative field. Also, the relationship between the Senate and the House of Representatives is considered a relationship of cooperation and complementarity to enrich parliamentary life in Egypt, and the Senate represents a positive development towards more democratic debate and in-depth analysis of phenomena and issues that can be resolved through efficient, quality and effective legislation.
