فعن بحثي هذا قول على جهة الاختصار وحصر الأفكار أتطرق فيه لمشكلة وعلاج وتوصية. فأما المشكلة فهي في كثرة المفتين وتساهل المستفتين لا سيما في ظل واقعنا المعاصر الذي يحمل في طياته المتغيرات والوقائع المتجددات مما أدى إلى الاضطراب وربما التضاد في الفتوى ما جعل بعض الناس بالفتوى يستهزئون وعن المتساهلين في نظرهم يبحثون. ثم تطرقت من خلال طيات صفحات هذا البحث للعلاج في نظر وذلك بوضع ستة أمور سميتها ضوابط الفتوى الواجب الأخذ بها يعالج لنا هذه المشكلة كلية أو جزئية بنسبة عالية ثلاثة خاصة بالمستفتي وثلاثة تتعلق بالمفتي ثم التوصية بإقامة مجلس أعلى للفتوى في العراق يضم علماء المسلمين المعتبرين في البلد كافة لحسم القضايا الشرعية المتجدد، والمتكررة كدخول رمضان وخروجه والمفطرات في الصوم والفدية فيه ومقدار زكاة الفطر وإلى غيرها ما يحدث فيها اختلاف بين عامة الناس في كل سنة إضافة إلى الأمور الطارئة كما يحدث الآن مع انتشار مرض (كورونا).
