المستخلص: The Jordanian legislator did not care about organizing the legal rules for the profession of the vehicle examiner where he did not organize them despite their importance and the role it plays in commercial and economic life and that those who deal with these professionals can sue them if the vehicle examiner in the course of practicing his work committed a professional or technical error where their responsibility arises towards the contract with them, and against others as a result of their reliance on the examiner's opinion in determining the price of the vehicle being examined. Because the Jordanian legislator did not issue a law regulating the profession of the vehicle examiner as well as professional standards for that profession, the Jordanian judiciary has subjected this type of responsibility to the same legal principles derived from general rules, which mainly focus on the elements of traditional civil liability of the malicious act, damage investigation, and the existence of the causal relationship between the harmful act and the damage. But the question remains: is the traditional division of civil liability sufficient to determine the responsibility of a vehicle examiner who is viewed not as an usual person but as a professional, careful, caring person who has not organized it despite its importance. So this study highlights the responsibility of the person who works in the profession of examining the vehicle in Jordan, and determinees the relationship with others, and determines responsibility when violating, and up to a kind of responsibility, which is the professional civil responsibility of the vehicle examiner in Jordan.

لم يهتم المشرع الأردني بتنظيم القواعد القانونية لمهنة فاحص المركبة، حيث لم يقم بتنظيمها على الرغم من أهميتها، والدور الذي تؤديه في الحياة التجارية والاقتصادية، وأن من يتعامل مع هؤلاء الفئة من المهنيين يستطيع أن يقاضيهم إذا ارتكب فاحص المركبة في أثناء ممارسته لعمله خطأ مهنياً أو فنياً حيث تنشأ مسؤوليتهم تجاه من تعاقد معهم، وتجاه الغير نتيجة لاعتمادهم على رأي الفاحص في تحديد ثمن المركبة المفحوصة . ولأن المشرع الأردني لم يصدر قانوناً ينظم فيه مهنة فاحص المركبة، وكذلك المعايير المهنية الخاصة بتلك المهنة، فقد أخضع القضاء الأردني هذا النوع من المسؤولية للمبادئ القانونية نفسها المستمدة من القواعد العامة، والتي تركز أساساً على أركان المسؤولية المدنية التقليدية من الفعل الضار، وتحقق الضرر، ووجود العلاقة السببية بين الفعل الضار والضرر. ولكن يبقى التساؤل: هل التقسيم التقليدي للمسؤولية المدنية كاف لتحديد مسؤولية فاحص المركبة الذي ينظر إليه الزبون ليس كشخص عادي، بل باعتباره صاحب مهنة، حريصاً، فطناً، ويقظاً له نظرة مهنية تفوق الشخص المعتاد. لذا فقد جاءت هذه الدراسة، لتسليط الضوء على مسؤولية من يعمل بمهنة فحص المركبة في الأردن، وتحديد علاقته بالغير، وتحدد مسؤوليته عند مخالفتها، وصولاً إلى نوع من المسؤولية، وهي المسؤولية المدنية المهنية لفاحص المركبة في الأردن.
