|a تتناول الدراسة المرافق العامة الاقتصادية (الهيئات والمؤسسات العامة الاقتصادية) في الكويت منذ نشأتها وحتى تاريخ إعداد هذه البحث، وتتصدى الدراسة لأهم التساؤلات المتعلقة بالأحكام القانونية التي تخضع لها الهيئات والمؤسسات العامة الاقتصادية في الكويت، من حيث تكوينها ونشاطها وعلاقتها بالإدارة وعلاقتها بموظفيها، وتقف على آخر التطورات التشريعية والمستجدات المتعلقة بها. وتجدر الإشارة إلى أن هذه الدراسة تتناول الهيئات والمؤسسات العامة الاقتصادية من حيث المعنى الواسع وليس الدقيق، فعلى الرغم من أن الغالب الأعم من هذه المؤسسات تقوم بأنشطة ذات طبيعة اقتصادية (تجارية، صناعية، مالية، زراعية) إلا أن بعض هذه الهيئات والمؤسسات العامة تمارس إلى جانب النشاط الاقتصادي عملا رقابيا على أنشطة اقتصادية، بل إن بعضها يمارس دورا رقابيا صرفا على تلك الأنشطة.\nوتطرح الدراسة عدة تساؤلات في محاولة للإجابة عليها وذلك من خلال البحث في القواعد القانونية والأحكام القضائية ذات الصلة، ولعل من أهمها ما يلي: ما هي الطبيعة القانونية للمرافق العامة الاقتصادية وما هي الأحكام القانونية التي تخضع لها عند الإنشاء والتنظيم؟ وهل تخضع المرافق العامة الاقتصادية؟ عند مزاولتها لنشاطها لقواعد القانون العام (القانون الإداري) وبالتالي تختص المحكمة الإدارية بنظر المنازعات المتعلقة بها؟ أم تخضع لقواعد القانون الخاص باعتبار أن هذه المرافق تقوم بأنشطة ذات طبيعة اقتصادية وتدار وفقا للفكر التجاري والاقتصادي وبالتالي تختص المحاكم العادية بنظر المنازعات المتعلقة بها؟ وما هي القواعد القانونية التي يخضع لها العاملون في المرافق العامة الاقتصادية، بمعنى هل تنطبق عليهم صفة الموظف العام وبالتالي يخضعون لقواعد القانون الإداري أم لا تنطبق عليهم تلك الصفة وبالتالي تنطبق عليهم قواعد قانون العمل في القطاع الخاص؟

|f The study deals with economic public facilities (economic bodies and institutions) in Kuwait from their inception until the date of preparation of this research. The study addresses the most important questions regarding the legal provisions to which public economic bodies and institutions are subjected in Kuwait, in terms of their composition, activity, relationship with management, and their relationship with their employees, and takes stock of the latest legislative developments related to them. It should be noted that this study deals with economic public bodies and institutions in terms of a broad meaning rather than the precise meaning. Although most of these institutions carry out activities of an economic nature (commercial, industrial, financial, agricultural); however, some of these public bodies and institutions, along with economic activity, exercise oversight over economic activities, and some even exercise a pure oversight role over those activities.\nThe study raises several questions in an attempt to answer them through research into the legal rules and relevant judicial rulings. The most important of which may be the following: What is the legal nature of public economic facilities, and what legal provisions are they subjected to when creating and regulating? Would the economic public facilities be subjected to the rules of common law (administrative law), and therefore the Administrative Court would have the jurisdiction to hear disputes related to them? Or are they subject to the rules of private law, given that these facilities carry out activities of an economic nature and are managed in accordance with commercial and economic thought, and therefore the ordinary courts have jurisdiction to hear disputes related to them? What are the legal rules to which workers in economic public facilities are subject, i.e., whether they would be described as public employees and therefore would be subjected to the rules of administrative law or such description would not be applicable to them and therefore the rules of private-sector labor law would apply to them?\nThis abstract translated by Dar AlMandumah Inc. 2021
