المستخلص: تأتى طريقة التفسير من قبل القاضي الدستوري مختلفة عن غيره، حيث يستهدف من تفسيره اعتبارات سياسية واجتماعية واقتصادية في ظل المصلحة العليا للجماعة؛ ولا يكتفى كغيره بمعايير وضوابط معتادة عند تفسير النصوص، بل يجب عليه أن يستوحى أفكارا، وضوابط مختلفة كثيرا عن غيره، وأن يستصحبها دائما وإياه بما لا يجعل الدستور أداة جامدة، معطلة الوثوب، مع قفزات الجماعة، أو يجعله آلة صماء، لا تجارى أوضاع الحكام، وأفكار الجماعة السياسية، وأهدافها.
إن التفسير الذي تجربة المحاكم الدستورية، ليس من شأنه أن يتدخل في سلطة المشرع التقديرية، ولا يحل محلها، ولذا تحرص المحاكم الدستورية على عدم المساس بالسلطة التقديرية للمشرع. فإذا كان من حق المحاكم الدستورية أن تقوم بالتفسير المنشئ، إلا أن ذلك لا يعطيها الحق في أن تصطدم بإرادة المشرع، بل عليها أن تعمل على التوفيق بين سلطتها في ابتداع التوفيق بين النص والهدف من وضعه والقصور الذي ألم به، وبين سلطة البرلمان في استقلاله بالعملية التشريعية.
إن التفسير المضيف يعمل على التدخل في المضمون القاعدي لنص القانون وإضافة ما يحتاجه النص لإعمال النقص الذي خرج عليه النص من البرلمان حتى يصبح النص مطابقا للدستور، فمن خلال القاضي الدستوري يمكن مراقبة القصور الوارد في القانون، ومن ثم سد ما أغفل عنه المشرع.
وكان للمحكمة الدستورية الإيطالية، والمجلس الدستوري الفرنسي، فضل السبق في معرفة التفسير المضيف للقاضي الدستوري، وإن كان موقف المحكمة الدستورية الإيطالية هو الأسبق والأقوى، لمعرفة العديد من الصور للتفسير المنشئ، والمكانة الكبيرة التي تلعبها في إيطاليا. واقتفى أثرها المجلس الدستوري في هذا الصدد. كما أن المحكمة الدستورية العليا في مصر كان لها مواقف متغايرة في شأن التفسير المنشئ حيث أخذت ببعض صوره دون بعض.


The method of interpretation by the constitutional judge is different from others. His interpretation is aimed at political, social, and economic considerations in the best interest of the group. Like others, he is not content with usual standards and controls when interpreting texts. He must inspire ideas and controls that are much different from others, and always accompany them, so that it does not make the constitution a rigid tool, or become silent with the jumps of the group, or make it a deaf machine, not trading the positions of the rulers, the ideas of the political group, and its objectives.
The interpretation experienced by the Constitutional Courts does not interfere with the legislator's discretion, nor does it replace it. Constitutional courts, therefore, ensure that the discretion of the legislator is not compromised. If the constitutional courts have the right to perform the constituent interpretation, this does not give them the right to collide with the will of the legislator. Rather, it must work to reconcile its authority in devising a reconciliation between the text and the purpose of its development and the incompetence that happened to it and between the authority of Parliament in its independence with the legislative process.
The added interpretation serves to interfere with the basic content of the text of the law and to add what the text needs to give effect to its imperfection from Parliament so that the text is in conformity with the constitution. Through the constitutional judge, the shortcomings contained in the law can be monitored, thus fill what the legislator has missed.
The Italian Constitutional Court and the French Constitutional Council have preferred to know the added interpretation of the constitutional judge, although the position of the Italian Constitutional Court is the first and most powerful, to understand many forms of the constituent interpretation and the great place it enjoys in Italy. Its impact was followed by the Constitutional Council in this regard. Egypt's Supreme Constitutional Court also had different positions on the constituent interpretation, it took some forms while abandoned some.
