|a يمثل قانون تشجيع الاستثمار المباشر في دولة الكويت رقم (116) لسنة 2013 الذي ألغى القانون رقم (8) لسنة 2001 في شأن تنظيم الاستثمار المباشر لرأس المال الأجنبي في دولة الكويت وحل مكانه في التطبيق، نقلة نوعية في الأحكام المنظمة للاستثمار المباشر، كما أن التطبيقات العملية لنصوصه في السنوات القليلة اللاحقة لصدوره فرضت نفسها من خلال ارتفاع ملحوظ في تدفقات الاستثمارات الأجنبية، كما ونوعا.\nتهدف هذه الورقة من خلال مبحثين إلى توضيح أبرز الأحكام المستحدثة التي تضمنتها نصوص القانون المشار إليه من خلال رؤية تحليلية ومقارنة (المبحث الأول)، ومن ثم الإضاءة على أبرز النتائج المحققة من تطبيقاته وأبرز التحديات التي تواجه تدفقات الاستثمار الأجنبي في الكويت والمؤثرة في فشله أو استمرار نجاحه (المبحث الثاني).\nولتوسيع دائرة الضوء على التغييرات والإيجابيات المفترضة شمل البحث في مستحدثات القانون الجديد (المطلب الأول)، تسليط الضوء بشكل أكبر على الأشكال القانونية التي يمكن أن تأخذها الكيانات الاستثمارية المرخصة من قبل هيئة تشجيع الاستثمار المباشر والآليات المرتبطة بترخيصها (المطلب الثاني) والضمانات والمزايا التي يمكن أن يستفيد منها المستثمر لتحفيزه على توطين استثماره ذي القيمة المضافة (المطلب الثالث).\nوللاطلاع أكثر على النتائج المحققة والتحديات المؤثرة في القانون رقم (116) لسنة 2013، استعرضت الورقة ما حققته هيئة تشجيع الاستثمار المولجة بتطبيقه من نتائج فيما يخص التزايد الملحوظ في حجم الاستثمار كما ونوعا (المطلب الأول)، إضافة إلى ما تسعى إليه لجهة رفع مستوى دولة الكويت في مؤشر سهولة ممارسة أنشطة الأعمال الصادر عن مجموعة البنك الدولي (المطلب الثاني)، ناهيك عن المسار السلس الذي انتهجته لمعالجات بعض الملفات الشائكة ولاسيما فيما يتعلق ببرنامج العمليات المقابلة "الأوفست" (المطلب الثالث)، الأمر الذي لا ينفي وجود مجموعة من التحديات الواقعية والقانونية المؤثرة والتي يجب التصدي لها والعمل الحثيث على تخطيها (المطلب الرابع).\n

|f The Direct Investment Promotion Law in the State of Kuwait No. (116) of 2013, which repealed Law No. (8) of 2001 regarding the regulation of direct foreign capital investment in the State of Kuwait and replacing it in implementation, is a qualitative leap in the provisions regulating direct investment. Moreover, the practical applications of its texts in the few years following its promulgation imposed themselves through a noticeable rise in foreign investment flows, both quantitatively and qualitatively.\nThis paper aims, through two sections, to clarify the most prominent new provisions included in the texts of the Law mentioned above through an analytical and comparative vision (the first section) and then highlight the most prominent results obtained from its applications and the biggest challenge facing foreign investment flows in Kuwait and affecting its failure or continuation of its success (the second section).\nIn order to broaden the spotlight on the presumed changes and positives, the research included the innovations of the new Law (the first topic), shedding more light on the legal forms that investment entities licensed by the Direct Investment Promotion Authority can take, the mechanisms associated with their licensing (the second topic), and the guarantees and advantages that can be taken by the investment entities, the guarantees, and advantages that the investor can benefit from motivating him to localize his value-added investment (the third topic).\nIn order to find out more about the achieved results and the challenges affecting Law No. (116) of 2013, the paper reviewed the results obtained by the Investment Promotion Authority entrusted with its application regarding the noticeable increase in the volume of investment in quantity and quality (the first requirement), in addition to what it seeks in terms of raising the level of the state of Kuwait in the ease of doing business index issued by the World Bank Group (the second topic), not to mention the smooth path it has taken to tackle some thorny files, especially with regard to the corresponding operations program “Offset” (the third topic), which does not negate the existence of a set of effective realistic and legal challenges, which must be addressed and vigorously worked to overcome it (the fourth topic). \nThis abstract translated by Dar AlMandumah Inc. 2021
