المستخلص: تتناول هذه الورقة دراسة أحكام العضوية في المجلس الدستوري على ضوء التعديل الدستوري لسنة 2016، بهدف الوقوف على مدى استقلالية المجلس الدستوري عضويا، والتي كانت مبررا أساسيا للتشكيك في موضوعية المهام الرقابية للمجلس الدستوري منذ نشأته، وذلك اعتمادا على المنهج التحليلي الوصفي المقارن. قيد المؤسس الجزائري العضوية في المجلس الدستوري بشرطي السن والخبرة القانونية، إلا أنه لم يحقق مبدأ تكافؤ فرص التقرير بين كل من السلطات التشريعية، القضائية، والتنفيذية، الأمر الذي قد يؤثر على الاستقلالية العضوية للمجلس الدستوري، التي ترتكز أساسا على الضمانات الدستورية والتنظيمية المقررة لحماية المركز القانوني لأعضاء المجلس الدستوري الجزائري.

This paper deals with the study of the provisions of membership in the Constitutional Council in the light of the constitutional amendment of 2016, with the aim of examining the extent of the organization's independence independently, which was a basic justification for questioning the objectivity of the oversight functions of the Constitutional Council since its inception, and that is based on the comparative descriptive analytical approach. The Algerian founder registered membership in the Constitutional Council with age and legal experience, but it did not achieve the principle of equal opportunity for reporting between each of the legislative, judicial, and executive authorities, which may affect the independence of membership of the Constitutional Council, which is mainly based on constitutional and organizational guarantees Determined to protect the legal status of members of the Algerian Constitutional Council.

cette étude traite les dispositions relatives à la composition du Conseil constitutionnel à la lumière de la révision constitutionnel de 2016, elle a pour objet la détermination de l'étendue de l'indépendance organique du conseil constitutionnel, ce qui était un justificatif fondamentale pour remettre en cause l'objectivité des fonctions de contrôle du constitutionnalité depuis la création du conseil constitutionnel, en se basant de l'approche analytique descriptive comparative. Le fondateur Algérien a déterminé deux conditions pour adirer au conseil constitutionnel; l'âge et l'expérience juridique, cependant il n'a pas respecté le principe de l'égalité des chances entre chacun des pouvoirs législatif, judiciaire et exécutif, ce qui peut affecter l'autonomie organique du Conseil constitutionnel, qui se base principalement sur des garanties constitutionnelles et réglementaires.
