المستخلص: Transport services play a key role in economic growth and the development of regions by facilitating their integration into exchanges, which comes in the context of globalization. It also contributes to improving the living standards of communities through the possibility of population movement. This article seeks to present the process of regulating the local public transport facility in Algeria by referring to the various reforms (legal, economic, financial, and social) carried out by public authorities since the beginning of the nineties of the last century. We will analyze the evolution of the control function carried out by the state and applied to the public transport facility in the context of the openness of the Algerian economy to competition and the liberation of some public utilities through networks (telecommunications, transport ...). We also showed the decline in the state's role and its transfer to the controlling state, which is now responsible for the respect of the functions of the public service in an organized framework. In the end, we are trying to answer the problem of the retreat and the return of the state to this sector.

Le service des transports joue un rôle primordial dans la croissance économique et le développement des territoires en facilitant leur intégration territoriale des échanges et dans le contexte de mondialisation. Il contribue également à l’amélioration du niveau de vie des sociétés en facilitant la mobilité de la population. Le présent article tente d’examiner le processus de régulation du service public local des transports en Algérie en se référant aux différentes réformes entreprises (juridiques, économiques, financières et sociales) par les autorités publiques depuis le début de la décennie 90. Nous analyserons l’évolution de la fonction de régulation de l’Etat appliquée au service public des transports qui intervient dans un contexte d’ouverture de l’économie algérienne à la concurrence et de libéralisation de certains services publics en réseau (télécommunications, transports, etc.) énonçant le recul de l’Etat tutélaire au nom d’un Etat régulateur soucieux du respect des missions de service public dans un cadre organisé. Enfin, nous tenterons de démontrer la problématique du désengagement – réengagement de l’Etat dans le secteur.

تلعب خدمات النقل دورا أساسيا في النمو الاقتصادي وفي تنمية الأقاليم عن طريق تسهيل إدماجها في المبادلات، ويأتي ذلك في سياق ظاهرة العولمة، كما تساهم أيضا في تحسين المستوى المعيشي للمجتمعات من خلال إمكانية تنقل السكان. هذا المقال يسعى إلى عرض سيرورة ضبط المرفق العمومي المحلي للنقل في الجزائر بالرجوع إلى مختلف الإصلاحات (القانونية، الاقتصادية، المالية والاجتماعية)، والتي قامت بها السلطات العمومية منذ بداية التسعينيات من القرن الماضي. سوف نقوم بتحليل تطور وظيفة الضبط التي تقوم بها الدولة والمطبق على المرفق العمومي للنقل، وذلك في سياق انفتاح الاقتصاد الجزائري على المنافسة وتحرير بعض المرافق العمومية عن طريق الشبكات (اتصالات، نقل.....)، كما بينا تراجع دور الدولة وانتقالها إلى الدولة الضابطة، والتي أصبحت تسهر على احترام مهام المرفق العمومي في إطار منظم، وفي الأخير، نحاول أن نجيب على إشكالية تراجع، وعودة الدولة إلى هذا القطاع.
