|a يعتبر التجريم والعقاب أحد أهم دعائم الحماية التي تتبعها الدولة لفرض سياستها الجنائية، حيث يتم تجريم أي سلوك يمس بمصلحة جديرة بالحماية، وحفاظا على تماسك الرابطة الزوجية، وحماية لطرفي العلاقة الزوجية أو أحدهما، جرم المشرع الجزائري عدة سلوكات من شأنها أن تؤدي إلى استقرار الحياة الزوجية، حرصا منه على ردع أي شخص يمكن أن يؤدي سلوكه إلى المساس بالحياة الزوجية، سواء أكان هذا الشخص أحد أطراف العلاقة الزوجية، أو كان من الغير، حيث تصدى المشرع لأي تصرفات يمكن أن تؤدي إلى المساس باستقرار الحياة الزوجية، وقرر عقوبات لمرتكب الأفعال المجرمة، وقد تشدد هذه العقوبات، وقد تخفف حسبما تقتضي حماية الرابطة الزوجية، كما قيد حرية النيابة العامة في تحريك الدعوى العمومية بوجوب حصولها على شكوى الزوج المضرور، بحيث لا يمكن للنيابة العامة أن تقوم بتحريك الدعوى العمومية تلقائيا، بل يجب أن تكون هناك شكوى من الزوج المضرور، وجعل المشرع صفح الضحية يضع حدا للمتابعة الجزائية، كل هذا حماية للرابطة الزوجية، وتذليلا لكل عقبات يمكن أن تقف في طريق استمرارها واستقرارها.

|b Criminalization and punishment is considered one of the-most-important pillars of protection-followed by the state to impose its criminal policy, whereby any behavior that violates a protection worthy interest is preserved, in-order-to-preserve the-cohesion of marital bond, and to protect parties to- marital relationship, or-one-of-them, the-Algerian legislator criminalized several behaviors that would lead to the-stability of marital life In order-to-deter any person whose behavior could lead-to prejudice the-marital life, whether this person is one-of the parties to the- marital relationship, or was from-others, where the legislator responded to any actions that could lead to prejudice the stability of marital life, and decided penalties for the perpetrator of the criminal acts, These have been tightened The penalties may-be-reduced as required by the protection of the-marital bond, as well-as restricting the Public Prosecution’s freedom to move the public lawsuit that it-must-obtain the complaint of the injured-husband, so-that the-Public Prosecution cannot automatically move the public lawsuit, but rather there should be a complaint from the injured husband, and make the legislator Forgiveness of the victim puts an end to the criminal follow-up, all this-to protect the-marital bond, and to-overcome all-obstacles that could stand in the way of its-continuation and stability.
