وسُم هذا البحث بـ"نظرات أصولية في بناء المصطلح والمفهوم عند الأصوليين" وهو عبارة عن دراسة منهجية، وكان الدافع إليه بعد مطالعة مدوناتهم وملاحظة ذلك فيها، إظهار حالة الإحكام والإتقان في البناء التقعيدي لهذه العلم، واستشعار لهذه الجهود واستثمارا لها في حركة الحياة وفق قانون الشرع الحكيم، وكانت إشكالية البحث بادية في كثرة مدونات أصول الفقه وشيوع شعور لدى قطاعات من الباحثين والمثقفين بتضخمها اللامفيد، فكان السؤال عن صحة هذا الشعور، أعقبه هدف الإجابة عن هذا السؤال، وكان المنهج المتبع الوصف والتحليل والتتبع المحدود، ولم تكن هناك دراسات سابقة مشابهة بعد اطلاع وبحث، وجاءت هيكليته في ثلاثة مباحث هي: المبحث الأول: إضاءات دلالية. المبحث الثاني: بناء المصطلح. المبحث الثالث: بناء المفهوم. والخاتمة، وقد خلص البحث في أهم نتائجه إلى أن بناء المنهجية الأصولية كان محسوب المقدمات والنتائج، محدد المصطلحات والمفاهيم بأعلى ممكنات الدقة والتحقيق، وتحاشى التداخل المضطرب الذي قد يحصل في المصطلحات فيؤدي لتشويش الفهم لمدلولات نصوص الوحي الشرعية والأوامر الشرعية. وأن تصور بعض الباحثين خلو فائدة البحث في بعض المسائل والمفاهيم تصور غير سليم من كل الجهات، لوحظ في التقعيد الأصولي حضور الواقع لملاحظة التجارب والعوائد والأصول وبناء المفاهيم عليها، وأن المقصود بقطعية الأصول القطع العادي لا القطع العقلي، وأن القطع قد يكون في الدليل وقد يكون في الدلالة وقد يكون في وجوب العمل.
