المستخلص: يعد مجلس الأمن جهازاً سياسياً مرجعيته ميثاق الأمم المتحدة مكلفا بأداء مهمة كبيرة وصعبة هي الحفاظ على السلم والأمن الدوليين، يتصرف نيابة عن المجتمع الدولي ويملك في ذات الوقت اتخاذ أي تدبير يراه ملائما لتحقيق ذلك الهدف، كما كان إنشاء المحكمة الجنائية الدولية حدثا قانونياً دولياً رائداً في تاريخ البشرية، فهي تعد جهازاً قضائياً مستقلاً بمرجعيتها المتمثلة في نظام روما، وقد حدد هذا الأخير علاقة المحكمة الدولية بمجلس الأمن من خلال منحه حق تحريك الدعوى بموجب الفصل السابع من ميثاق الأمم المتحدة وفقا للمادة 13 من النظام الأساسي، كما أعطى لمجلس الأمن إرجاء التحقيق أو المقاضاة لمدة سنة كاملة قابلة للتجديد بناء على طلبه بموجب نفس الفصل وفقاً للمادة 16 من النظام الأساسي، وهذا ما يعد مساسا لعمل المحكمة وخرقا لاستقلاليتها، وهو ما سنحاول تسليط الضوء عليه في هذه الورقة من خلال معرفة العلاقة الموجودة بين مجلس الأمن والمحكمة الجنائية الدولية ومدى تأثيره عليها.

Le Conseil de sécurité est considéré comme un système politique, son autorité est de la Charte des Nations Unies, il est exigé d’accomplir une grande tache importante et difficile qui est de maintenir la paix et la sécurité internationale; le conseil agit au nom de la communauté internationale et prend en même temps toute mesure qu'il juge appropriée pour atteindre cet objectif. De même que la construction de la Cour pénale internationale était un évènement juridique international très répandu dans l'histoire de l'humanité. Ainsi que la cour pénal est considéré comme un système judiciaire indépendant dans son autorité inspirée du statut de Rome; Ce dernier qui a identifié la relation de la cour international avec le Conseil de sécurité a travers de lui donner le droit déclencher la subvention en vertu du Chapitre VII de la Charte des Nations Unies et conformément à l'article 31 du Statut. Aussi ce système a donné au Conseil de sécurité de reporter l’enquête et le jugement durant toute une année renouvelable selon sa demande dans le cadre du même chapitre et conformément à l'article 31du Statut; Ce qui influe le travail de la cour et considéré comme un manquement de son indépendance, Et cela, dont nous allons essayer de mettre en évidence dans cette étude a travers la connaissance de la relation entre le Conseil de sécurité et la Cour pénale international et son influence sure elle.

The Security Council is a political body with reference to the Charter of the United Nations entrusted with a great and challenging task of maintaining international peace and security, acting on behalf of the international community and at the same time having the power to take any measure it deems appropriate to achieve that goal, just as the establishment of the International Criminal Court was a pioneering international legal event in human history. It is an independent judicial body with its reference represented in the Rome Statute. The latter defined the relationship of the International Tribunal with the Security Council by granting it the right to initiate proceedings under Chapter VII of the Charter of the United Nations in accordance with Article 13 of the Statute, and also gave the Security Council to defer investigation or prosecution for a full year, renewable at its request under the same chapter under Article 16 of the Statute, and this is a violation of the work of the Court and a violation of its independence, which we will try to highlight in this paper by identifying the relationship between the Security Council and the International Criminal Court and the extent of its impact on it.
