المستخلص: The stability of the law applicable to investment is one of the most important guarantees that the foreign investor seeks to obtain in the host countries for his investment, especially the developing ones, with what it achieves in terms of protection and safety, and enables him to achieve his goals according to what he planned when making the investment decision, without fear of any new amendments and procedures that may harm his interests. Therefore, we will explain through this study how, with the aim of attracting and encouraging incoming foreign investment, the host countries resort to granting this guarantee to the foreign investor, either by including a condition that guarantees stability in the investment contracts they conclude with foreign investors, especially investments of importance to the national economy or by providing for this guarantee in its internal law and thus becomes a general guarantee for all investments. La stabilité de la loi applicable sur l’investissement est considérée comme étant une des importantes garanties que l’investisseur étranger essaye de l’avoir dans les pays qui accueillent son investissement, et plus spécialement, les pays en développement, avec ce que cet élément peut accomplir sur le plan de la protection, la sécurité et la réalisation des objectifs fixés par l’investisseur, selon sa planification lors de la prise de sa décision d’investissement, sans être inquiété par les modifications et les nouvelles procédures qui peuvent nuire à ses intérêts. Pour cela, je vais éclaircir, à partir de cette étude comment les pays hôtes peuvent recourir à offrir cette garantie à l’investisseur, afin de faire emmener et encourager l’investissement étranger. A cette fin, il pourrait soit: (A) intégrer une clause qui garantit la stabilité dans les contrats d’investissement conclus avec les investisseurs étrangers, spécialement qui présentant un intérêt pour l’économie national, (B) ou bien rédiger un texte qui contient les prescriptions de cette garantie dans leur droit interne, afin d’être une garantie générale de toutes les investissements.

يعتبر استقرار القانون المطبق على الاستثمار من أهم الضمانات التي يسعى المستثمر الأجنبي للحصول عليها في الدول المضيفة لاستثماره خصوصا النامية منها، بما يحققه له من حماية وأمان، ويمكنه من تحقيق أهدافه حسب ما خطط له عند اتخاذ قرار الاستثمار، دون التخوف من أي تعديلات وإجراءات جديدة قد تضر بمصالحه، لذلك سنوضح من خلال هذه الدراسة كيف تلجأ الدول المضيفة بهدف جلب وتشجيع الاستثمار الأجنبي الوافد، إلى منح هذا الضمان للمستثمر الأجنبي، ويكون ذلك إما بإدراج شرط يضمن الاستقرار في عقود الاستثمار التي تبرمها مع المستثمرين الأجانب، خصوصاً الاستثمارات ذات الأهمية للاقتصاد الوطني، وإما بالنص على هذا الضمان في قانونها الداخلي وبالتالي يصبح ضمان عام لجميع الاستثمارات.
