المستخلص: The role of the Constitutional Council has grown in political systems. In addition to its competence in prevention, it has exercised power to decide on many constituent and legislative issues as the body established to cover the deficit recorded by the organization based on the tripartite division of functions. Under its control function of the law, it amends, interprets, and repeals legal provisions with opinions and decisions that are can't be subjected to appeal. However, these actions are not considered a sovereign act because of the lack of independent will of the Council either in terms of the possibility of triggering the procedure or in terms of substance. The Algerian constitutional system has held the work of the Council under control so that it remains technical without a sovereign status, thus preventing legislative adaptation of regulatory action on laws. Actuellement, la fonction du conseil constitutionnel ne se limite pas seulement en contrôle passif des lois car il exerce une faculté de statuer dans les domaines constitutionnels et législatifs. Donc, il abroge, interprète, modifie des dispositions législatives par des avis ou décisions définitifs. Bien qu’aucune institution n’ait la possibilité de recourir, on ne peut les considérer en tant qu’actes de souveraineté étant dépourvus de volonté autonome. Cette conclusion trouve son origine dans la procédure de la saisine et les limites constitutionnelles de fond: le conseil en statuant n’exprime pas une volonté, il défend les dispositions constitutionnelles. Par conséquent, la fonction du conseil reste un acte technique non normatif.

تنامت وظيفة المجلس الدستوري في الأنظمة السياسية إذ مارس إلى جانب اختصاصه في المنع سلطة البت في كثير من المواضيع التأسيسية والتشريعية باعتباره الهيئة المنشأة لتغطية العجز الذي سجله التنظيم المبني على التقسيم الثلاثي للوظائف. فبموجب وظيفته الرقابية على القانون، يعدل ويفسر ويلغي أحكاما قانونية بآراء وقرارات لا تقبل الطعن. إلا أن هذه الأعمال لا تعتبر عملا سياديا لانعدام الإرادة المستقلة للمجلس سواء من حيث إمكانية تحريك الإجراء أو من حيث الموضوع. كما أن النظام الدستوري الجزائري قيد عمل المجلس ليبقى تقنيا دون صفة سيادية مما يحول دون التكييف التشريعي للعمل الرقابي على القوانين.
