المستخلص: كل الاتجاهات الوظيفية ترى أن للدولة ثلاث وظائف قانونية: وهي الوظيفة التشريعية تتلخص في إصدار القواعد المجردة، ووظيفة تنفيذية يقتصر مجالها على تنفيذ القوانين، أما الوظيفة القضائية فتعمل على تطبيق هذه القواعد المجردة على الوقائع المعروضة، هذا التعبير الأخير هو شكل واحد من تنفيذ القوانين مما يجعل الوظيفة القضائية أقرب إلى الوظيفة الثانية. فإذا كان الاتفاق سائد حول إطلاق وصف السلطة على التنفيذ والتشريع في الفقه الدستوري فإن الاختلاف على أشده بخصوص مركز القضاء؛ إذا كان سلطة مستقلة أو تابعة للإدارة.

Ou point de vue fonctionnel, l'état exerce trois fonctions: la fonction législative qui consiste à élaborer des règles abstraites, la fonction exécutive qui se limite à l'exécution des lois, mais la fonction juridictionnelle n'est que l'institution qui assure la pratique régulière des lois sur les faits. Cette dernière expression institutionnelle n'est qu'une forme d'exécution des lois, ce qui la rapproche de la deuxième fonction. C'est pourquoi, la doctrine constitutionnelle n'a pas décider définitivement à propos du statut de la juridiction; pouvoir ou autorité, autonomie ou subordination à l'administration.

All functional directions consider that the State has three legal functions: the legislative function is to issue abstract rules, the scope of executive function is limited to the implementation of laws, while the judicial function applies these abstract rules to the facts presented. This last expression is one form of law enforcement that brings the judicial function closer to the second function. If there is an agreement on the description of authority over implementation and legislation in constitutional jurisprudence, the difference is most severe regarding the status of the judiciary, whether it is an independent authority or subordinate to the administration.
