المستخلص: Les marchés publics, étant l’un des principaux circuits à travers lequel circulent les biens publics, sont considérés comme un mécanisme de développement au sein de l’Etat. Ceci a contraint le législateur à adopter des lois spéciales les régissant et qui les distinguent des autres contrats. Or, la corruption et les passes droits régnant au sein des entités publics ont fait de ce système un moyen de pillage et de gaspillage des biens publics au détriment des projets d’intérêt général. Face à ce symptôme, le législateur algérien s’est trouvé dans l’obligation d’intervenir à plusieurs reprises en vue de protéger ces biens. D’où la création de structures institutionnels dont les prérogatives consistent, entre autres, en la détection des infractions et de traduire leurs auteurs en justice. Parmi ces structures, figure la cour des comptes afin de mettre un terme à la corruption en matière des marchés publics.

تعد الصفقات العمومية أهم مسار تتحرك فيه الأموال العامة، بحيث فهي من بين أهم آليات التنمية في الدولة، مما دفع بالمشرع إلى أن يخص تنظيمها بقانون خاص يميزها عن بقية العقود الأخرى. غير أن الفساد الذي عم واستفحل في الوسط الإداري جعل من هذه العقود أداة لنهب المال العام وهدره على حساب مشاريع خصصت للمنفعة العامة. أمام هذه الظاهرة، فكان لزاما على المشرع الجزائري التدخل بصفة مستمرة لحماية تلك الأموال من خلال وضع آليات وأجهزة مؤسساتية تعمل على الكشف عن الأفعال الإجرامية وإحالة مرتكبيها على القضاء، ومن بين هذه الأجهزة نجد مجلس المحاسبة الذي قررته النصوص القانوني كآلية ضمن صلاحياته للحد من الفساد في مجال الصفقات العمومية.

Public procurement as main path in which circulates public goods are considered a primary mechanism of development, that why parliament has established special laws that distinguish them from others. Yet, corruption has made this system a means of plundering and squandering of public assets .Thus Algerian laws were made to interpose in order to protect the public’s goods .Some devices and mechanisms were elaborated to detect infraction and bring the perpetrators to justice. Among those devices council of the accounting.
