520 |d Le droit algérien, qui fait l’objet d’attentions soutenues chez certains auteurs, place la famille parmi ses valeurs fondamentales. Il la subordonne, ainsi que le mariage qui est sa base, à la dignité, à l’entente, à la mansuétude et à l’affection. Or, il n’en demeure pas moins que la jurisprudence, dans l’application des dispositions du code de la famille, hésite entre plusieurs conceptions doctrinales en matière de nullité du mariage. Ces dernières se sont déve¬loppées dans plusieurs directions et, par conséquent, ne sont cependant pas parvenues à éclairer du discours juridique la notion d’erreur, pas plus que de celle des qualités dites essentielles de la personne. Cette orientation fait une grande place à la volonté des conjoints sur la validité de leur union matrimoniale. Or, cette orientation connait d’im¬portantes limites : le consentement ne peut pas être tout puisqu’il ne faut pas qu’il soit vicié. Mais, les vices du consentement peuvent porter aussi bien sur l’identité civile et physique que sur les qualités essentielles de la personne. En présence de ces vices, il convient de se demander, lesquels rendent le mariage entaché d’une cause de nullité? 
520 |a يضع القانون الجزائري، بحكم الاهتمام المستمر لدى بعض الكتاب، الأسرة ضمن قيمه الأساسية، إذ يعلقها، كالزواج الذي هو أساسها، على الكرامة، والتفاهم، والعطف. بيد أن الحقيقة تظل أن القضاء، عند تطبيقه لأحكام قانون الأسرة، يتردد بين عدة مفاهيم فقهية تتعلق ببطلان الزواج. وقد تطورت هذه المفاهيم في عدة اتجاهات، وبالتالي لم تنجح في تسليط الضوء على مفهوم الغلط في الخطاب القانوني، ولا على ما يسمى بالصفات الجوهرية للشخص. ويولي هذا التوجه اهتماما كبيرا لإرادة الزوجين على صحة الزواج. غير أنه علقها بعدة قيود أساسية: فالرضا لا يمكن أن يكون كل شيء، بحيث لا ينبغي أن يكون مشوبا بعيب. إلا أن عيوب الإرادة يمكن أن تشمل الهوية المدنية والجسدية والصفات الجوهرية للشخص. وفي وجود هذه العيوب، من الضروري أن نتساءل، أي من الأسباب تجعل الزواج باطلا؟

The fact remains, however, that the jurisprudence, in applying the pro-visions of the Family Code, hesitates between several doctrinal conceptions concerning the nullity of marriage. The latter have developed in several di-reactions and, therefore, have not succeeded in shedding light on the notion of error in the legal discourse, nor on that of the so-called essential qualities of the person. This orientation makes much room for the will of spouses on the validity of their marital union. However, this orientation has important limitations: consent cannot be everything since it must not be vitiated. However, vices of consent can include both the civil and physical identity and the essential qualities of the person. In the presence of these vices, it is necessary to ask, which make the marriage tainted by a cause of nullity?
