المستخلص: يعتبر مبدأ استقلالية القضاء الدستوري أحد أهم المبادئ في الدولة، وتنبع هذه الأهمية من أهمية القضاء الدستوري كجهاز في مختلف المجالات الدستورية والقانونية والاجتماعية...، كونه يعزز أسس وأركان الدولة القائمة على سيادة الدستور والسهر على احترام أحكامه ومبادئه، وكذا حماية الحقوق والحريات الأساسية للمواطن. وبما أن الدستور هو الذي يحدد السلطات الثلاث في الدولة ويحدد صلاحياتها، فلابد على هذه الأخيرة أن تحترم الإطار الذي حدده لها الدستور. وبناء على ذلك وجد جهاز "القضاء الدستوري" لممارسة الرقابة على أعمال هذه السلطات، غير أن ممارسته لهذه الرقابة تتطلب استقلاليته في مواجهتها، ومنه وجد "مبدأ استقلالية القضاء الدستوري"، الذي يتناوله هذا البحث. كما تناولنا في هذا نموذج الفدرالية الروسية في مجال القضاء الدستوري وتجسيد مبدأ استقلاليته، نظراً لخلفيتها التاريخية في هذا المجال وما مرت به من "أزمة دستورية" من جهة، ونظراً لكونها دولة فدرالية مما يجعل من توفير هذا المبدأ تحدياً حقيقياً.

The principle of the independence of the constitutional Justice is considered one of the most important principles in the State, this importance comes from the importance of the constitutional Justice as an organ in various fields: constitutional, legal, social...; as it reinforces the foundations of the State based on the supremacy of the Constitution and ensures respect for its provisions and principles, as well as the protection of the fundamental rights and freedoms of the citizen. And Since the Constitution defines the three powers of the State and determines its powers, the latter must respect the framework established by the Constitution. Thus, the Constitutional Justice has been established to exercise control over the actions of these authorities, but this control requires its independence toward them, and based on this the ‘’principle of the independence of the constitutional Justice’’ was born, which is addressed in this paper. We also discussed the model of the Constitutional Justice in the Russian Federation and the embodiment of this principle, given its historical background in this area especially through the ‘’Constitutional crisis’’, and on the other hand because it is a federal State, which makes guarantying this principal even more challenging.
