المستخلص: علم مقاصد الشريعة تقنين فعلي لعلم أصول الفقه وضبط لمسائل الفقه العامة في قواعد وكليات وأصول مقاصدية محددة شاملة وجامعة ومبينة لمعاني وأقسام المصالح والمفاسد وضوابط الكشف عن صحيحها وفاسدها، وطرق الموازنة بين المصالح والمفاسد عند تزاحمها، وبيان مجالات تطبيق القاعدة المقاصدية الكبرى في جلب المصالح ودرء المفاسد، ثم بيان أقسام الوسائل الشرعية لتحقيق المقصد العام للشريعة الإسلامية في التخفيف ورفع الحرج والمشقة ووسائل المحافظة على الدين والنفس والنسل والعقل والمال والعرض. ومن أجل التعرف على هذا العلم الجليل وبيان علاقته بعلم أصول الفقه.. قام الباحث بتناوله في مقدمة وثلاثة مباحث للإجابة على عدة أسئلة: • ما هي ماهية المقاصد الشرعية؟ وما أهميتها؟ وما موضوعها؟ وما هي أدلة ثبوتها؟ • ما هي علاقة مقاصد الشريعة بأبرز مصطلحات أصول الفقه؟ ومن ثم توصل الباحث إلى: 1. أن المقاصد العامة للشريعة الإسلامية ثابتة لا تتغير بتغير الزمان والمكان والأمم. 2. أنها عبارة عن تقنين متكامل لعلمي الفقه وأصوله لأنها تنزيل الأحكام المجردة على وقع الأحداث ومستجدات الأمور. 3. شدة حاجة كل من الأصولي والفقيه والمفتي إلى معرفتها كونها الأساس الذي ينبغي عليه اجتهاد المجتهدين.

Knowledge of the purposes of Sharia is an actual codification of the science of the fundamentals of jurisprudence and a control of general jurisprudence matters in the rules, colleges, and principles of specific, comprehensive and inclusive purposes, indicating the meanings and divisions of interests and corruption, the controls for revealing their validity and their corruption, the methods of balancing between interests and corruption when they compete, and the areas of application of the major intended rule in bringing interests and preventing evil Then, explaining the sections of the legal means to achieve the general purpose of Islamic law in easing and lifting embarrassment and hardship, and the means of preserving religion, soul, offspring, reason, money and honor. In order to identify this noble science and explain its relationship with the science of usul al-fiqh.. the researcher addressed it in an introduction and three topics to answer several questions: • What are the legal objectives? What is its importance? What is its theme? What are the evidence to prove it? • What is the relationship between the objectives of the law and the most prominent terms of jurisprudence? And for that, the researcher concluded: 1. That the general purposes of Islamic law are fixed and do not change with the change of time, place and nations. 2. It is an integrated codification of the science of jurisprudence and its fundamentals, because it is the download of abstract rulings on the impact of events and developments in matters. 3. The severity of the need for each of the fundamentalist, jurist and mufti to know it, as it is the basis upon which the diligence of the mujtahids should be.
