المستخلص: كثرت المؤلفات المعاصرة التي تتناول المقاصد الشرعية، وتعددت، وتنوعت، وتفاوتت في دراسة المقاصد؛ وكان من أهمها ما اتجه إلى دراسة استثمار المقاصد الشرعية وضوابط اعتبارها؛ إذ يعد التصنيف في هذا الاتجاه تصنيف في أهم ثمرة من ثمرات دراسة هذا العلم، وغاية من غاياته؛ إذ تتبين منه الإفادة من المقاصد الشرعية، والميادين التي تستثمر فيها من خلالها، وتحكيم قواعدها في مجال الاختلاف والتعارض، وفهم النصوص والتعامل معها، واعتبار الأقوال والأحكام، وتوجيه الفتاوى، وغير ذلك من مجالات استثمار المقاصد الشرعية. وهذا البحث يتناول كشف مارات التأليف في هذا الاتجاه عند المعاصرين، مع ذكر أبرز المصنفات في كل مسار؛ ذلك أن المؤلفات المعاصرة المختصة بدراسة استثمار المقاصد الشرعية لم تسلك طريقا واحداً ولم تأخذ شكلاً محدداً، وإنما سلكت مسالك متعددة، واتخذت مسارات مختلفة؛ فبعضها تناول دراسة أهمية استثمار المقاصد الشرعية والحاجة إليها ووقع تطبيقها وتدريسها في الوقت الحالي، ومنها ما اختص بدراسة وسائل استثمار المقاصد وتحقيقها وكشفها وادركها وحفظها وتفعيلها، ومنها ما تناول دراسة استثمار المقاصد الشرعية وتفعيلها بوجه عام، ومنها ما اتجه لدراسة ضوابط اعتبار المقاصد واستثمارها، ومنها ما اتجه إلى دراسة أحكام المسائل والنوازل في ضوء المقاصد الشرعية، ومنها ما اختص بدراسة فقه استثمار المقاصد، ومنها المؤلفات المختصة بدراسة التحديات والعقبات التي تواجه استثمار المقاصد الشرعية وتطبيقها.

Contemporary literature dealing with legal objectives has abounded, varied in the study of objectives. And among the most important of them was what he tended to study the use of legitimate purposes and the control of their consideration. As classification in this direction is a classification in the most important benefits of the study of this science, and one of its objectives. As it becomes evident to benefit from the legal objectives, the fields in which he invests in, the arbitration of its rules in the field of difference and conflict, the understanding of texts and dealing with them, the consideration of statements and judgments, the guidance of fatwas, and other areas of applying of the legitimate purposes. This research deals with revealing the paths of authorship in this direction among the contemporary, with mentioning the most prominent works in each path. This is because the contemporary literature specialized in studying the usage of legitimate purposes did not follow a single path and did not take a specific form. Rather, it followed multiple paths, and took different paths. Some of them dealt with studying the importance of using legal objectives, the need for them, the reality of their implementation and teaching at the present time, and some of them were concerned with studying the means of using the objectives, their realization, detection, awareness, preservation and activation, and some of them dealt with studying the investment of legitimate purposes and their implementation in general, and some of them meant to study the controls of considering and using the objectives, including What tended to study the provisions of issues in the perspective of the legal objectives, and some of them were devoted to studying the jurisprudence of using the objectives, including the literature specialized in studying the challenges and obstacles facing using of legitimate purposes and their application.
