520 |f The legislator has defined a set of legal texts to protect the Waqf (mortmain) property from the danger of extinction and loss as well as benefiting from it by investing and developing it according to its nature and under the administration and control of the State without ignoring the will of the Waqif (who created the Waqf). The exploitation of the Waqf (property) cannot be based on violating the will of the Waqif, in accordance with the rule of “the condition of the waqif is as the condition of the legislature.” However, if such a condition would stand an obstacle to achieving the greater benefit, the judge may rule otherwise.\nThis abstract translated by Dar AlMandumah Inc. 2021 
520 |a لقد حدد المشرع مجموعة من النصوص القانونية لحماية الملك الوقفي من خطر الاندثار والضياع، وكذلك الاستفادة منه عن طريق استثماره وتنميته كل حسب طبيعته وتحت إدارة ورقابة الدولة دون تجاهل إرادة الواقف، فاستغلال الوقف لا يمكن أن ينبني على مخالفة إرادة الواقف وذلك تطبيقًا لقاعدة "شرط الواقف كشرط الشارع"، أما إذا كان هذا الشرط سوف يقف عقبة في طريق تحقيق منفعة أكبر فللقاضي أن يحكم بغير ذلك.  
520 |d Le législateur a identifié un ensemble de dispositions légales pour protéger le bien Wakf de l'extinction et de la perte, ainsi que pour s’en servir en les investissant et en les développant, chacun selon sa nature et sous la direction et le contrôle de l'Etat sans ignorer la volonté du constituant, où l’exploitation du moratoire ne peut être fondée sans la volonté du constituant vu l’application de la règle "exigence debout comme une rue", mais si cette condition constitue un obstacle devant la réalisation d’un grand bénéfice, le juge peut prononcer un autre jugement.
