المستخلص: The human body enjoys inviolability and immunity in international legislation, in general, and Algerian legislation, in particular. Therefore, the Algerian legislator has allowed the sick consumer protection in the legislation protecting health by establishing obligations for the doctor and pharmacist as professionals. The doctor's obligations include informing (the patient about his overall health condition), patient satisfaction, and providing treatment, while the obligations of the pharmacist also include informing (the patient) and communicating about the dangers of the medicine due to the danger that it possesses towards the health of the consumer patient. To monitor the compliance of both the doctor and the pharmacist, several regulatory bodies have been established, including the National Pharmaceutical Agency, the Medical Ethics Council, and the Physicians Union; however, these bodies have not yet ensured integrated protection for the consumer patient, thus necessitating a re-intervention by the legislator to review the system of health legislation.

يتمتع الجسد الإنساني بحرمة وحصانة في التشريعات الدولية عامة والتشريع الجزائري خاصة لذلك أولى المشرع الجزائري للمستهلك المريض حماية في تشريعات حماية الصحة حيث رتب التزامات على عاتق الطبيب والصيدلي باعتبارهما محترفين حيث تتمثل التزامات الطبيب في الالتزام بالإعلام ورضا المريض والتزام بتقديم العلاج أما الصيدلي هو الأخر يقع على عاتقه التزامات تتمثل في الالتزام بالإعلام والإفضاء بمخاطر الدواء نظرا لخطورته على صحة المريض المستهلك ولمراقبة مدى التزام كل من الطبيب والصيدلي بالتزامهما تم إنشاء هيئات رقابية تتمثل في الوكالة الوطنية للمواد الصيدلانية، مجلس أخلاقيات الطب، ونقابة الأطباء، إلا أن هذه الهيئات ما زالت لم تكفل حماية متكاملة للمريض المستهلك مما يتطلب ضرورة إعادة تدخل المشرع لإعادة النظر في منظومة تشريعات الصحة.
