المستخلص: Protection of consumer security with regard to goods and services he procures is a primary objective of the Consumer Law and shows the importance of this obligation even more in the field of medical and pharmaceutical products. The consumer contract here falls on products directly affecting the health of the consumer. Because of the increased risks to consumer health caused by either non-conformity of pharmaceutical security standards or lack of information and security for medical services, consumer protection must be required under this type of product. Therefore, the Consumer Protection Act worked with the Health Protection and Promotion Act, as well as the executive decrees on health legislation, to establish rules to ensure the security of medical and pharmaceutical products. How effective are the laws relating to the security of medical and pharmaceutical products in providing effective protection to the consumer? To answer this problem, the topic was studied by addressing the following stages: The first topic: Scope of commitment to the security of medical and pharmaceutical products; second topic: rules of security of medical and pharmaceutical products.

La protection et/ou la sécurité du consommateur sur ce qui achète comme produits ou service est l’objectif principal de la réglementation sur le consommateur et cet engagement se montre plus d’importance dans le domaine des produits et services médicaux et pharmaceutiques. De sorte que ces produits et services touchent directement la sécurité ou santé du consommateur, et qui sont causés soit par la non conformité des produits pharmaceutiques par rapport aux mesures de sécurité adoptés (normes), ou le manque de l’information par rapport à ces produits ou services, la protection du consommateur est devenue une obligation dans le cadre de ces produits et services. Pour cela, la réglementation du consommateur et celle de la protection et promotion de la santé ont maintenus des règles pour assurer la sécurité des produits et services médicaux et pharmaceutiques. La problématique qui se pose est dans quelle mesure l’efficacité des règlements en matière des produits et services médicaux et pharmaceutiques pour fournir une protection efficace pour le consommateur ? Pour répondre à cette problématique, deux chapitres ont été étudiés: Chapitre 1: champs d’engagement à la sécurité des produits et services médicaux et pharmaceutiques. Chapitre 2: les règles de la sécurité des produits et services médicaux et pharmaceutiques.

تعد حماية أمن المستهلك بشأن ما يقتنيه من سلع وخدمات هدف أولي لقانون الاستهلاك وتظهر أهمية هذا الالتزام أكثر في مجال المنتوجات الطبية والصيدلانية، ذلك أن محل عقد الاستهلاك هنا يقع على منتوجات تمس مباشرة بسلامة صحة المستهلك، ونظرا لتفاقم الأخطار التي تمس بصحة المستهلك والناجمة إما عن عدم مطابقة المواد الصيدلانية لأمن المقاييس المعتمدة أو نقص في الإعلام والأمن بالنسبة للخدمات الطبية، وجبت حماية المستهلك في إطار هذا النوع من المنتوجات. لذلك عمل قانون حماية المستهلك مع قانون حماية الصحة وترقيتها، بالإضافة إلى المراسيم التنفيذية المتعلقة بتشريعات الصحة على وضع قواعد لضمان أمن المنتوجات الطبية والصيدلانية. فما مدى نجاعة القوانين المتعلقة بأمن المنتوجات الطبية والصيدلانية في توفير حماية فعالة للمستهلك؟ للإجابة عن هذه الإشكالية تم دراسة الموضوع من خلال التطرق للمراحل التالية: المحور الأول: نطاق الالتزام بأمن المنتوجات الطبية والصيدلانية، المحور الثاني: قواعد أمن المنتوجات الطبية والصيدلانية.
