المستخلص: As a result of various developments in various socio-economic and technological fields, etc., this increased the gap between contractors whose relations were loomed over by equality and that was perceived by the legislator who rushed to find a solution, especially with the increasing manifestations of abuse of the weak party who does not have sufficient knowledge and experience to conclude a contract without abuse.
The manifestations of protection appear in the legislator's devotion to various legal mechanisms under special provisions other than those recognized in the general Shariah, by enacting the Consumer Protection Act and the Act on the Determination of Rules Applicable to Business Practices, which was followed by an executive decree setting out the basic elements of contracts conducted between economic agents and consumers and clauses deemed to be arbitrary.

À la suite de divers développements dans différents domaines socio-économiques... Etc. qui a conduit à accroître le fossé entre les contractants qui ont campé sur leur égalité, discerner le législateur, qui se précipite pour trouver une solution, surtout avec l’augmentation des manifestations de la violence sur la partie faible qui ne pas avoir suffisamment de connaissances et d’expérience lui permettent de conclure le contrat sans abus.
Et la Protections semblent consacrer à divers mécanismes juridiques en vertu de dispositions spéciales ,émettant droit de la protection de consommateur et le droit relatif à la détermination des règles applicables aux pratiques commerciales, suivies d’un décret exécutif défini pour les éléments de base des contrats entre les agents économiques et les consommateurs et les éléments qui sont considérés comme abusifs.


نتيجة مختلف التطورات في شتى المجالات الاقتصادية الاجتماعية التكنولوجية ... الخ أدى ذلك إلى زيادة الهوة بين المتعاقدين اللذين كان يخيم على علاقاتهما المساواة، مما تفطن المشرع وسارع إلى إيجاد حل، خاصة مع زيادة مظاهر التعسف على الطرف الضعيف الذي لا يملك من المعرفة والخبرة الكافية التي تمكنه من إبرام عقد دون تعسف.
وتظهر مظاهر الحماية في تكريس المشرع لمختلف الآليات القانونية بموجب نصوص خاصة غير تلك المتعارف عليها في الشريعة العامة، بإصداره لقانون حماية المستهلك وقانون المتعلق بتحديد القواعد المطبقة على الممارسات التجارية، الذي أتبعه بمرسوم تنفيذي المحدد للعناصر الأساسية للعقود المبرمة بين الأعوان الاقتصاديين والمستهلكين والبنود التي تعتبر تعسفية.
