المستخلص: هذا بحث يشتمل على مسائل المنازعات التي تحدث بين الزوجين في المصوغات الذهبية، تكون البحث من مقدمة وفصل واحد وخاتمة، وكان الفصل بعنوان: إبراز الأحكام لما استجد بين الزوجين من خصام في مسائل المصوغات الذهبية، واشتمل على ثلاثة مباحث، كل مبحث منها يعالج النزاعات التي تحدث في فترة زمنية معينة. المبحث الأول: يعالج المنازعات الحاصلة على المصوغات الذهبية أثناء فترة الخطبة، واشتمل على مطلبين، كل مطلب يعالج جانباً مما يحصل من نزاع بين الخاطبين على المصوغات بعد العدول عن الخطبة، وتعويض الضرر الناشئ عن فسخ الخطبة بالاحتفاظ بالمصوغات كنوع من التعويض، وهل يصح ذلك شرعاً أو لا؟ والمبحث الثاني: بعنوان: تنازع الزوجين في المصوغات الذهبية أثناء قيام الحياة الزوجية، واشتمل على أربعة مطالب؛ الأول بعنوان: التكييف الفقهي للمصوغات الذهبية المدونة في قائمة المنقولات، والثاني بعنوان: تصرف الزوجة في المصوغات الزوجية المدونة في القائمة، والثالث بعنوان: تصرف الزوج في المصوغات الذهبية أثناء قيام الحياة الزوجية، والرابع بعنوان: جعل المصوغات الذهبية رأس مال في تجارة، وناقش هذا المبحث كثيرا من المسائل المعاصرة التي يحتاج الفقيه أن يخرج فيها برأي له حظ من النظر، يلائم العصر ولا يناقض ثوابت الشرع. والمبحث الثالث بعنوان: تنازع الزوجين في المصوغات الذهبية بعد انتهاء الحياة الزوجية، وتنتهي الحياة الزوجية إما بطلاق أو خلع أو فسخ أو موت، ولكل منها مسائل تختص بالمصوغات، ولا يغيب عنها النزاع، تعرض المبحث لهذه المنازعات في مطالب، كل منها يعالج تنازعا يحدث بين الزوجين أو الورثة، وتعرض المطلب الأخير لمسألة ظفر الزوجة بجزء من التركة: هل لها أن تأخذ منها ما يقابل مصوغاتها التي أخذها زوجها ولا بينة لها بذلك؟ وانتهى البحث بخاتمة وتوصيات تبين أهم النتائج التي توصل إليها البحث.

This research paper discusses some issues of disputes that occur between spouses over gold jewels. It consists of an introduction, one section and a conclusion. The section, entitled "Investigating rulings on new issues of dispute that arise between spouses in matters of gold jewels" includes three subsections, each of which explores certain disputes that occur in a certain period of time. The first subsection deals with the conflicts that arise over gold jewels during the period of engagement. It includes two headings, each of which addresses a certain aspect of dispute that occurs between the engaged couple over gold jewels after ending engagement. It discusses the ruling of compensating the damage resulting from breaking off the engagement by retaining the jewelry. It investigates whether or not this kind of compensation is legitimate. The second subsection, entitled "The spouses' dispute over gold jewels during the period of marital life", includes four headings. The first heading is entitled "Juristic justification of gold jewels recorded in the list of movable commodities". The second heading is entitled "The wife’s disposing of marriage jewelry recorded in the list of movable commodities. The third heading is entitled "The husband's disposing of marriage jewelry during the period of marital life". The fourth heading is entitled "Making use of gold jewelry as capital in a business". It discusses a great deal of contemporary issues that a jurist needs to contemplate and scrutinize to come out with an insightful view that fits the modern age without contradicting the principles of Sharia. The third subsection, entitled "The spouses' dispute over gold jewels after marital life termination". Marital life ends with either [man's] divorce, or khul (woman's divorce) through compensation paid by wife; there can also be dissolution of marriage, or death. Each case of marital life termination is disputed about and has its own issues related to gold jewels. This subsection explores these disputes in separate headings, each of which is concerned with a certain dispute that occurs between spouses or heirs. The final subsection addresses the issue of the wife’s acquisition of part of her deceased husband's property. It raises the question of whether she has the right to take a part of the property equivalent to the jewelry which her husband took without evidence therefor The study ends with a conclusion and recommendations showing the most important results of the research.
