|a يأخذ النظام الدستوري الأردني بمنح السلطة التنفيذية صلاحية إصدار قوانين مؤقتة في حال كان مجلس النواب منحلا" بهدف مواجهة الظروف الاستثنائية التي قد تواجهها الدولة والتي تستدعي إصدار تشريعات ضرورية ولازمه لمواجهة مثل هذه الظروف غير العادية، ولما كان الدستور الأردني قد منح السلطة التشريعية صاحبة الولاية العامة في ممارسة الاختصاص التشريعي المقرر دستوريا، إلا أنه خرج عن هذا الأصل ومنح السلطة التنفيذية حق التشريع وفقا لأحكام المادة (٩٤) في الدستور الأردني، إلا أن هذا الحق ليس مطلقا للسلطة التنفيذية بل إحاطة المشرع بمجموعة من الضوابط والضمانات التي تتمثل في الرقابة البرلمانية والرقابة القضائية على هذه القوانين المؤقتة لضمان التزام السلطة التنفيذية بأحكام الدستور.

|b The Jordanian constitutional order grants the executive authority the authority to issue provisional laws in the event that the House of Representatives is dissolved "in order to meet the exceptional circumstances that may be faced by the state and which require the issuance of necessary legislation and necessary to face such unusual circumstances. The legislative authority is constitutionally vested, but it has deviated from this principle and granted the executive power the right to legislate in accordance with the provisions of Article 94 of the Jordanian Constitution. However, this right is not absolute for the executive branch, Parliamentary control and judicial control over these temporary laws to ensure that the executive branch complies with the provisions of the Constitution.
